Action Requested
Adopt,by motion,resolution for summary publication of Ordinance No. 14-06, an ordinance providing
for the control of Fats, Oils, and Grease (FOG) in the city sanitary sewer system.
Background/Discussion
The Fats, Oils, and Grease (FOG) Control Ordinance was adopted at the May 5, 2014, City Council
meeting as required by the MS4 Stormwater Permit. The purpose of the ordinance is to limit or prevent
FOG from Food Service Establishments (FSE) or Food Manufacturer/ Processors (FM/Ps) from
entering the city's sanitary sewer system.
Staff recommends the city publish a summary of the ordinance via the attached resolution to fulfill all
legal publication requirements as completely as if the entire ordinance had been published
Financial Impact
Adopting the resolution for summary publication of the ordinance will save the city on publication costs.

Member introduced the following resolution and moved its adoption:
A Resolution of the Elk River City Council Approving Notice of Summary
Publication of Ordinance No. 14-06, an Ordinance Providing for the Control of
Fats, Oils and Grease (FOG) in the City Sanitary Sewer System
WHEREAS, increased demand on the City's Sanitary Sewer System and Publicly Owned
Treatment Works necessitates implementing more stringent rules and regulations on waste
dischargers; and
WHEREAS, on May 5, 2014, the Elk River City Council adopted Ordinance No. 14-06 amending
Sections 78-91, 78-93 and 78-156, of the Elk River Code of Ordinances; and
WHEREAS, Ordinance No. 14-06 provides for the control of fats, oils and grease (FOG) in the
City Sanitary Sewer System by:
- Adopting definitions of FOG,Best Management Practices (BMPs), FOG
Enforcement Response Plan (ERP),Food Service Establishment (FSE), Food
Manufacturer/Processor (FM/P) and related terms;and
- Establishing a City FOG Control Program;and
- Requiring FSE's and FM/P's to participate in the City FOG Control Program
and adopt BMP's and ERP's; and
- Providing for enforcement and penalties for noncompliance with the FOG
Control Program;and
WHEREAS, a copy of the full text of Ordinance No. 14-06 is available for inspection by any
person at the office of the Elk River City Clerk, 13065 Orono Parkway, during regular business
hours,Monday through Friday.
NOW, THEREFORE, be it resolved, that the City Council, by at least four-fifths vote, authorizes
publication of the tide and a summary of Ordinance No. 14-06.
The motion for the adoption of the foregoing resolution was duly seconded by Member
, and upon vote being taken thereon,the following voted in favor thereof-
and the following against: ,whereupon said resolution was declared duly
passed and adopted.
