MEMORANDUM TO: FROM: Mayor and City Council Lori Johnson, Finance Director DATE: November 13, 2001 SUBJECT: Consider Special Assessments Re Resolution Adopting and Levying Assessments for Unpaid Garbage Collection Services Attached is a list of property owners who had delinquent garbage bills as of September 1, 2001. The total amount of garbage assessments to be levied is $6,548.48, which is slightly higher than the amount assessed last year. This assessment includes a ten percent penalty and six percent interest on the delinquent garbage amount. Action Requested City Council is asked to approve the attached resolution 01-__ adopting and levying assessments for unpaid garbage collection services as of September 1, 2001. Be Special Assessment Reapportionments Attached is a list of special assessment reapportionments that reallocate existing assessments to newly platted lots. Action Requested As requested by Minnesota Statutes, the City Council is asked to approve the special assessment reapportionments as stated on the Special Assessment Reapportionments list attached to this memo. C. New Assessments There are several property owners who have connected to municipal sewer and water who were not previously assessed for lateral connections. Those property owners have signed waivers authorizing the lateral assessment to be assessed against their property. Additionally, several properties in the east Elk River area have either come into the urban service district or are now being developed and trunk water and sewer assessments need to be levied. These assessments are included as part of the developer's agreement for each of these projects. Additionally, the city is levying a water service line improvement to a property owner on behalf of Elk River Municipal Utilities, and again, the property owner has requested that this service be assessed. Action Requested City Council is asked to approve the special assessments totaling $559,233.35 as listed on the New Special Assessments, November 13, 2001, page attached to this De Senior Citizen Deferred Assessments Mary Juhl has applied for a senior citizen deferral of the 2001 street overlay assessment for her property at 832 Vernon Avenue (parcel number 75-425-0150). Ms. Juhl meets all the requirements for the deferral. Action Requested The City Council is asked to approve the deferment of Mary Juhl's 2001 street overlay assessment. S/Council/SpecialAsses sments RESOLUTION 0 I- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ADOPTING AND LEVYING ASSESSMENTS FOR UNPAID GARBAGE COLLECTION SERVICES AS OF SEPTEMBER I, 2001 WHEREAS, Minnesota Statutes Section 433.015 authorizes the City to annually levy an assessment equal to such unpaid cost as of September 1 of each year for garbage collection services at an interest rate not to exceed 6% and a penalty not to exceed 10%; and, WHEREAS, the City's ordinance Section 602.12 Subdivision 3, authorizes the City to levy an assessment against property for garbage collection equal to the unpaid charges as of September 1; and, WHEREAS, all customers and property owners with delinquent balances as of September 1, 2001, have been given adequate notice of this pending assessment and have been given opportunities to pay prior to this assessment being levied; and, WHEREAS, State law does not require a public hearing or notice before levying such assessments. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River that the parcels and amounts listed on Exhibit A attached hereto, are correct and made a part hereof, are to be levied at an interest rate of 6% per annum with a 10% penalty, and are to be certified to the Sherburne County Auditor.
