Overview
The applicant is requesting that the existing drainage and utility easements on Lot 4, Block 3,
Woods at Hillside Second Addition be vacated. A wetland has been identified on this lot
and the drainage and utility easements have to be revised to include this wetland. This lot
will be replatted as part of Woods at Hillside Third Addition and accurate drainage and
utility easement will be included on the new lot.

Recommendation
Staff recommends that the City Council approve Resolution No. 02- vacating the
existing drainage and utility easements on Lot 4, Block 3, Woods at Hillside Second
Addition with the following condition:
1. The lot be replatted as part of the Woods at Hillside Third Addition.

FINAL PLAT
Dear Ms. McPherson:
As requested, we have reviewed the final plat of The Woods at Hillside Third Additiom
our review, we would offer the following comments:
Based on
The plat includes the replat of Lot 4, Block 3, The Woods at Hillside Second Addition. This
lot is included because a wetland was found to be existing on Lot 4, Block 3, which made
the lot essentially unbuildable. Therefore, it is being replatted with the third addition to be
slightly larger so that there is a buildable location. We would recommend that the existing
drainage and utility easements around Lot 4 be vacated as necessary and replatted with the
third addition.
2. There are various outlots throughout the plat for the median along 193rd Avenue and the
islands in the cul-de-sacs. All of these outlots should be covered by drainage and utility
easements so that utilities can freely cross under them.
3. The islands in the "eyebrow" cul-de-sac along 193rd Avenue and in 192nd Court do not meet
the new City standard for design of a cul-de-sac island. However, they do meet the same
standards that were used for the cul-de-sac islands in the first and secood additions.
4. The right-of-way east of Vance Street on 193rd Avenue is proposed to be used for ponding
on an interim basis. The concept from the original The Woods at Hillside Development Plan
was to use this area for ponding and to eventually move the pond further to the east as
i93rd Avenue is extended to Tyler Street. It would be appropriate with this plat to formalize
the agreement with the Developer whereby he would escrow sufficient funds to eventually
fill in the pond and extend the sewer, water, storm sewer, and street to the east plat
boundary.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 02-07
WHEREAS,
the property owner abutting the street, drainage, and utility easement has
requested the City Council in a petition dated June 20, 2002, to vacate such
easement according to law; and,
WHEREAS,
a public hearing was held on July 15, 2002, before the City Council at the Elk
River City Hall on such petition after due published and posted notice had
been given as well as personal notice to affected property owners on July 2,
2002, and all persons interested were given an opportunity to be heard; and,
WHEREAS,
it appears that it will be in the best interest of the City to approve such
peuuon.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage, and utility easement described as follows is hereby vacated:
Lot 4, Block 3, Woods at Hillside Second Addition
Adopted by the Elk River City Council this 15th day of July, 2002.
