A Resolution of the Elk River City ouncil Approving Notice of Summary
Publication of Ordinance No. 14,-06, an Ordinance Providing for the Controll of
Fats, Oils and Grease (FOG) in the City Sanitary Sewer System
WHEREAS, increased demand on the City's Sanitati
y Sewer Systemand Publicly Owned
Treatment Works necessitates implementing more stringent rules and regulations on waste
dischargers; and
WH E REAS, on May 5, 2014, the 1,'Ik River City adopted (..)rdinance No. 14-06 amending

Sections 78-91, 78-93 and 78-156, of the Elk River Code of Ordinances; and
WHEREAS,, Ordinance No. 14-06 provides for the control of fats, oils and grease (FOG) in the
City Sanitary Sewer System by:
Adopting definitions of 1,OG, Best i\lanagernent practices (BMPs), l,'O(-',
Enforcement Response plan (ERP), F'ood Service: Establishment (FSFI), Food
Manufacturer/Processor (FNI/1") and related terms; and

E'stablishing a C , `(_)G I Control Program; and
Requiring, FSF,'s and FM/P's to participate in the City FOG Control Program
and adopt BMPs and ERP's; and
Providing for enforcement and penalties for noncompliance with thel'OG
Control Program; and
WHEREAS, a copy of the full text of Ordinance No. 14-06 is available for inspection by any
person at the office of the Elk River City Clerk, 13065 Orono parkway, during regular busiliess
hours, Monday through FridaNp.
NOW, THEREFORE, be it resolved, that the City Council, by at least four-fifths vote, authorizes
publication of the title and a sumiriary of Ordinance No. 14-06,.
The motion for the adoption of the foregoing resolution was duly seconded by Member
Motin , and upon vote being taken thereon, the followliag voted in favor thereof:
Mayor Dietz, Councilmembers Wilson, -Westgaard, Burandt, and Motin
and the following against: no one whereupon said resolution was declared duly,
passed and adopted.
