Action Requested
Approve,by motion, Conditional Use Permit, Case No. CU 14-13, to Brian Brehmer for rental business
at Ralphie's Victor Lane with the following conditions:
1. The Conditional Use Permit is not a building permit and the applicant must apply for and receive
approval of all required permits before construction may begin.
2. The applicant must apply for and receive approval of all required sign permits before signage may
be installed.
3. No more than 16 rental vehicles and trailers shall be on site at any given time. (Exhibit B)
4. No equipment other than trucks and trailers may be displayed.
5. Rental vehicles and trailers shall not exceed 26 feet in length.
6. No drive area may be obstructed.
7. Five (5) additional trees shall be installed by October 1, 2014.
Staff recommends only 10 rental vehicles be allowed (Exhibit A)
Background/Discussion
Case No. CU 14-13
The Planning Commission reviewed this application at their May 27, 2014, regular meeting. The
commission had no concerns with the proposal.
Staff recommended to the commission that only 10 rental vehicles be allowed to minimize the visual
impacts,in accordance with the city's beautification program. The applicant indicated he has had up to 8
trucks (vans) and 6 trailers (14 vehicles), but he would like to be allowed a maximum of 16 vehicles
during peak times. A commissioner stated they would rather not limit a stable business to a number less
than what they currently have been operating with,and would rather see more screening added.
The Planning Commission unanimously recommended approval of the request with 16 rental vehicles
allowed on site. (Exhibit B) Staff recommends only 10 rental vehicles be allowed as the rentals are an
accessory use, and to prevent the rental area taking over the site. (Exhibit A)

Background/Discussion
The applicant recently purchased the property, and it was noted that a permit for the existing auto rental
was never issued. The property is zoned C3 Highway Commercial where both car sales and equipment
rental are conditional uses. The applicant would like to lease moving vehicles and trailers.As part of the
city beautification goals, the city began more aggressively enforcing zoning ordinances at city entrances
and along primary corridors.
Access and parking
The site is accessible from Highway 10 and Business Center Drive. The convenience store structure
includes areas for additional tenants. The site has 27 parking stall available for the business(es). Based
on calculations from an aerial,it appears the building is about 4,500 square feet in size,requiring 22
parking stalls. Although several of these parking stalls will be utilized by the rental equipment,it does not
appear there are any parking issues with the property. Upon approval of this request,if parking becomes
a problem, there are areas on site to add additional parking stalls. This is consistent with our"proof of
parking"provision.
Equipment
The equipment that is rented is vans, trucks, and hitch trailers. The applicant estimates up to 14 vehicles
is typical. The applicant currently has the rental vehicles where the previous owner(s) have had them,in
the south and western portion of the parking lot.

INATURE
The city ordinance does not allow trucks to be utilized for the sole purpose of advertising. Staff is
recommending that all rental vehicles be located where they will not compete with the parking for the gas
station or additional future tenants and where they will not be interpreted as signage. Because of the city
beautification goals, staff recommends the 10 dedicated stalls be located in the south and southeast
portion of the property (Exhibit A).
Signage
The signage plan is to have a sign under the existing gas station sign. All signage will need to meet
current city code.
Landscaping
Per ordinance, 30 trees are required. In situations where the landscaping requirements are not met, the
City has required modifications in scale with the proposed business. Based on aerial photography,there
are five trees on the property. Staff suggests that five addition trees be added. These trees should be
over story and approved by staff.

U-Haul Conditional Use Permit
To whom it may concern,
I plan to keep the U-Haul rentals where the previous owner kept them as you can see from the enclosed
ariel site plan,They will be kept in the front western lot.The signage plan is to have a U-Haul sign under
the gas sign. The equipment that we will be renting out is vans,trucks,and hitch trailers.Our plan is to
