Action Requested
Recommend, by motion, approval of the Interim l-se Permit extension request by Spectrum High School
to utilize the space at 17534 Industrial Circle for wrestling and fitness classes in the Business Park Zoning
district, with the following conditions:
1. The Interim Use Permit (IUP) shall expire on June 1, 2015, or when the gym
facility at 17834 Industrial Circle is no longer in use,whichever occurs first.
2. Additional extensions to the IUP will not be granted.
3. As an Interim Use Permit is not a Building Permit, the applicant shall obtain all
required permits, including approvals from the Fire Chief, City Engineer and
Building Official.
4. The standards for issuance of the Conditional Use Permit (CU 10-22) shall
continue to be maintained.
5. Due to the industrial nature of the neighborhood, the school recognizes that noise,
odors, truck traffic, and other undesirable effects may be present.
Background/Discussion
Spectrum High School is requesting a one year extension of their Interim l-se Permit (II'P) to hold
fitness and wrestling programs at 17534 Industrial Circle. Spectrum recently received approval to establish
a sixth grade campus at 11044 Industrial Circle, which includes a new gym space. The fitness and
wrestling programs \\ill move to the new gym, but it is not expected to be completed until the fall/winter
of 2014. The extension will ensure the activities continue, uninterrupted, through the winter months. The
Il-P \\ill expire when the fitness equipment is remo\ed from 1-'534 Industrial Circle or dune 1, 2015,
whichever occurs first
Spectrum received appro\al for the original I l-P in 2010, and has received three extensions. 1 he latest
extension expires .1ugust 15, 2014.
Analysis
Negative impacts to the surrounding businesses from the use have not been recorded, nor are the\
expected. Practices are generally held after school, \Ionda\ through 11rida■. Students walk from the
school to practices, and the space is not used for competition.

Staff supports the Il'l' as the use has been continual since 20111 without significant impacts to
surrounding businesses. .ldditionall\, the use is expected to end later this y ear with the completion of
Spectrum's sixth grade education center at 11044 Industrial Circle NW.

Dear Mr. Carlton,
We are writing to request a twelve month extension for the Interim Use Permit (IUP)for the
property at 17834 Industrial Circle. We will discontinue use of the property at 17834 Industrial
Circle if we are able to move into the gymnasium of the new 6th Grade Education Center before
the end of the twelve month extension of the IUP. The property at 17834 Industrial Circle is
used for the Spectrum wrestling program and other afterschool athletic activities. The current
IUP expires on August 15, 2014.
We anticipate opening the new 6th Grade Education Center this fall. Since the gymnasium in
the 6th Grade Education Center may not be completed until October, the additional twelve
months for the IUP will offer either a seamless transition for after school activities from the
warehouse space to the new gymnasium or an extension if the 6th Grade Education Center
project is delayed for up to one year.

December, 2010, on a petition for a Conditional Use pursuant to the City of Elk River Zoning
Ordinance, for the following described property:

I'1'IS ORDERED that a Conditional Use be granted as upon the following conditions or reasons:
