1. Park Dedication Fund Balance
The current balance as of February 28, 2002, was $833,607.48.
2. Update, Grace Assembly of God Church Park Land Acquisition
Attached is the latest correspondence between the Church and the City regarding the
purchase of 10 acres of land adjacent to the Royal Oaks Ridge subdivision.
3. Orono Park Master Plan Options and Phasing
We are in the process of preparing several options for the Commission to consider at a
later meeting. In the interim, the only change during the Public Safety Facility
construction will be the removal of Orono Road from Orono Parkway to Gary Street.
Gary Street will remain connected to Orono Road to the west.

Dear Pastor Kallevig:
Thank you for your letter dated February 11,2002 outlining the church's position for the sale of
land to the City. City staff,including Patrick Klaers,City Administrator;Lori Johnson,Director
of Finance;Terry Maurer,City Engineer,and I reviewed your request on February 21,2002. We
carefully evaluated the items delineated in your letter and have come to the conclusion that we
• cannot meet the items requested in your letter.
The City Council authorized staff to enter into negotiations for 10 acres of land at $145,000
($14,500 per acre). The additional items you have requested in your letter go well beyond the
original offer proposed by Pastor Mike Olson. In addition,several items you have requested
clearly violate City policy;specifically paying for SAC and WAC fees on behalf of a private entity
within the City.
We would like to continue negotiations on the following offer: (1)purchase 10.5 acres of land
for $145,000 in cash and (2) process the preliminary and final plat at the City's cost. We will
adjust the amount of park land line as noted on the attached drawing. The City does not intend
to provide access to the park property from Twin Lakes Road, and will provide access to the
park from the Royal Oaks Ridge subdivision to the west.
If you find that this offer is unacceptable and desire the pursuit other options,we understand
this. The City,however,does wish to provide a park for the neighborhood,and hopes that an
agreement can be reached for the sale of land. Please contact me at your earliest convenience to
inform me as to the church's intentions. If yota have any questions regarding this letter,please

SUBJECT: Conditions for sale of 11.22 acres to the City of Elk River for use as a city park
Dear Michelle:
Hello from Grace Assembly of God Church.
Sunday evening,February 10, the voting members of our church approved the sale of 11.22 acres of our
church property to the City of Elk River,remaining church property being 13.2 acres. The church
members also agreed that for the sale to be complete, Grace A/G would request the following:
1. That the total cash amount of$145,000.00 be paid to Grace A/G at closing, closing costs to be paid by
buyer.
2. That within a 6-month period, a road be installed by the City off of County Road 13 on the church
side of the property line, located next to the Jordan farm, the road continuing up, turning to the right,
ending in a parking area on the 11.22 city park acreage. NOTE: The property to build this road will
be donated by Grace A/G to the City. The church would have use of this street to access the church
Ill parking lot with an"in"driveway and an"out" driveway provided off the street and a sidewalk from
County Road 13 to the park for pedestrian traffic be constructed by the City. Also,the land necessary
for a right turn lane onto County Road 13 will be donated by Grace A/G.
3. That the City provide sewer and water(including SAC and WAC fees)to our proposed building site.
4. That Grace A/G will provide to the City a variance for water at no charge, and sewer if needed,to
extend facilities from Royal Oaks Ridge through our property to County Road 13,running as close to
our property line as possible.
5. That approval of a conditional use permit for the church building be granted to Grace A/G.
We believe this is a fair offer and are ready to sign a sale agreement with the City at this time.
