Recommend, by motion, the Planning Commission open the public hearing, continue the public hearing,
and postpone action on the item until their August 26, 2014 regular meeting.
Overview
The application is for the two preliminary plats,West Oaks Fifth and Sixth Additions. The applicant will
also be requesting final plat approval for the fifth addition with the city council.
Background/Discussion
The subject parcel is Outlot A of West Oaks 4`h Addition.
5th Addition
• Five detached units
• Original preliminary plat showed eight attached
6th Addition
• Twelve attached units
• Consistent with the original preliminary plat
The zoning for the subject property is R-3 which has established lot sizes for single family homes. The
minimum lot width is 80 feet and minimum lot size is 12,000 square feet. The proposed lot
configurations for the fifth addition (50' & 60' x 96.25) are not consistent with the R-3 zoning. There are
two options to resolve this issue. They can plat the fifth addition with fewer lots that meet the
ordinance requirements or have the fifth and sixth additions rezoned to a Planned Unit Development.
Staff is supportive of the rezoning.
Financial Impact
None
Mn Statute 15.99 deadline
The City must take action by August 30, 2014. As the application will exceed the first 60 day period, staff
will extend the 60 day period which will require action by October 30, 2014.

Thank you for your applications for the preliminary and final plats of West Oaks 5th and 6`h
On June 30, 2014, the city received your application for the above use. Staff conducted a thorough
site plan review on July 8, 2014 and has the following comments:
Utilities
1. Please provide drawings on how the proposed detached units are to be hooked up to the city
sewer and water system and how existing systems will be abandoned,if applicable.
2. Impacts and costs associated with moving/abandoning existing sewer,water,gas, electric,
phone, and cable lines will be the developer's responsibility and you should coordinate with
the appropriate agency(s) as needed.
Environmental
3. Please see the memo, dated July 9, 2014, from the Environmental Technician.
Land use/Zoning
4. The zoning for the subject property is R-3 which has established lot sizes for single family
homes. The proposed lot configurations for the fifth addition are not consistent with the R-
3 zoning. There are two options to resolve this issue. You can plat the fifth addition with
three lots that meet the ordinance requirements or have the fifth and sixth additions rezoned
to a Planned Unit Development.
Staff supports the rezoning the PUD to accommodate the detached townhome housing style,but to
do so, it is necessary to postpone Planning Commission action on the item until August 26th. This

will allow us to develop the PUD documents so the Planning Commission and City Council can
review near final versions at their respective public hearings. The Planning Commission will review
the application on August 26, 2014 and pending a recommendation that night,your application
would go before the City Council for action on September 2, 2014. This will add only two weeks to
the original schedule.

Subject: Site Plan Review Comments
At the Site Plan Review on July 8,2014,we discussed wetland easements for a number of
proposals.
According to 30-418,
(2) Easements shall be provided along each side of the centerline of any watercourse or
drainage channel,whether or not shown in the comprehensive development plan,to a width
sufficient to provide proper maintenance and for stormwater runoff for the designed storm
event determined by the city,but such easements shall not be less than 20 feet in width.
The ponds on Kliever Lake Fields 5th Addition are not designated wetland so I agree that the
easement should at least stay as it was platted for the townhomes (at least 20 feet.)
I propose a minimum of 45-foot drainage easement around all wetlands at Natures Edge
Business Center 2"d Addition, as per our City Code 30-1852 that requires a 25-foot Wetland
Buffer Strip and an extra 20-foot Wetland Buffer strip setback which does not allow
structures,principal or accessory. Creating the 45-foot easement will let potential developers
plan accordingly.
The West Oaks 6`h Addition should also include a 45-foot drainage easement surrounding
the wetland in between the planned townhomes and single family homes. The current
easement does not include the minimum 20-foot easment and should be altered to include
the 45-foot drainage easement per the wetland ordinance 30-1852.
