Action Requested
1. Mayor Dietz to open and close the public hearing.
2. Adopt,by motion, an ordinance amending the 2014 Master Fee Schedule to add fats, oils, and
grease control enforcement tier levels.
Background/Discussion
On May 5, 2014, the Council adopted an ordinance regarding fats, oils, and grease control.
On May 19, 2014, the Council reviewed and approved the Enforcement Response Plan outlining tier
levels and the types of violations occurring at each level.
On July 7, 2014, the Enforcement Response Plan was amended to remove tier level penalty amounts and
place them in the 2014 Master Fee Schedule as directed by the City Attorney.
The Chief Operator will investigate compliance with the FOG Control Policy/Sewer Use and Sewer Use
and Discharge Requirements Ordinance through:
a) On-site inspections of FSE and FM/P's,including scheduled and unscheduled visits;
b) Review of documentation of required cleaning/maintenance of grease retention units;
c) Review of records/activities required to be documented and maintained by the User;
d) Review of procedures and implementation of Best Management Practices outlined in FOG
e) Control Policy;
f) Investigation of sanitary sewer overflows and spill and illegal discharges
The FOG Control Ordinance takes effect November 5, 2014,which is the end of the 180-day grace
period granted at the May Council meeting.

An Ordinance Amending the 2014 Master Fee Schedule to Add Fats, Oils, and
Grease Enforcement Tier Levels of the City of Elk River, Minnesota, City Code
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That the 2014 Master Fee Schedule of the City of Elk River Code of Ordinances
shall be amended to add the following fees:
Fats, Oils, and Grease Control Enforcement Tier Levels
The following civil penalties for violation of the city Fats, Oils, and Grease Control Ordinance, Section 78-956, of the
City Code, as provided in the city Fats, Oils, and Grease Enforcement Response Plan.
■ Tier I Notice of Deficiency/Notice to Correct—No penalty
■ Tier II Notice of Violation— $0 - $50
■ Tier III Notice of Violation— $75 - $100
■ Tier IV Notice of Violation— $150 - $500
■ Tier V Notice of Violation— $500 - $1000
■ Tier VI Notice of Violation— $1000 - $10,000. (Possible Consent or Administrative
Order)
■ Tier VII Consent Order/Administrative Order with Stipulated Penalties
■ Tier VIII Consent Order/Administrative Order with Stipulated Penalties and Termination
of Sewer Service
SECTION 2. That this ordinance shall take effect November 5, 2014, and be published as provided
by law.
