LS 14-02,LS 14-03, and LS 14-04 Horst Graser, owner, GSS Properties LLC, and Carla Biederman representing the Kliever Lake Fields East Townhome Association,are requesting to split three lots in the Kliever Lake Fields East Plat. Two parcels,Lots 21 and 23, are the common areas that surround the habitable lots within the Kliever Lake Fields East development. The third parcel,Lot 7,is a townhome lot owned by GSS Properties LLC. Ownership of the six lots will be split between the two applicants. The townhome association will own and continue to maintain the property around their 10 units. The proposed lot splits are the first step in a larger project,Kliever Lake Fields 5"',which includes re- platting the 36 vacant townhome lots to 22 single-family lots. The Planning Commission will review the re-platting applications on July 22, 2014. Access and Easements The common lots,Lots 21 and 23,have frontage on public streets, but are not buildable as they are encumbered by existing drainage and utility easements. The easements will be modified to accommodate the lot configurations as part of the Kliever Lake Fields 5"'application. The plat and easement vacation applications are scheduled for the August 18, 2014, City Council meeting. Horst Graser (GSS Properties LLC) Carla Biederman (Kliever Lake Fields East Townhome Ass.) Proposal: The above petitioners are requesting the city council of Elk River to approve splits for lot 23 block 1, lot 21 blocks 2, and lot 7 block 1. Lots 23 and 21 are the common areas for the entire Kliever lake Fields East plat. Lot 7 is a townhome lot. The principle purpose of the proposal is to divide the common area, a portion of which will remain with existing 10 units as require by the declaration and the balance will be deeded back to GSS Properties LLC. A small piece of lot 7 will also be deed to the homeowners association. The Kliever Lake Fields East Townhome Association will continue to function as a 10 unit Association and is in favor of these lot splits. The lot splits will not create buildable lots nor will any side or rear yard setback requirements-be compromised. History of Kliever Lake Fields East: Kliever Lake fields East was platted and constructed in 2004 by GSS Properties LLC as a townhome development consisting of 42 townhome lots. In 2005 the entire plat was sold to a builder who constructed 10 units (lots 1-6 block 1 and lots 1-4 block 2). Unfortunately the entire common area in the plat was deeded to the Kliever Lake Fields East Townhome Association at the time. Primarily due to market and economic conditions, the builder defaulted and GSS Properties acquired title to the remaining 32 lots. Efforts have been made to market the lots over the last 7 years with almost no interest. DATE RECEIVED Proposed Proiect: GSS Properties has a signed purchase agreement with Tim Pomerlue, a home builder for all the property in Kliever Lake Fields East not owned by the association plus 4 adjacent townhome lots. Mr. Pomerlue is proposing to replat the 36 lots into 22 detached singe family townhome lots. His proposal has been submitted to staff and will be heard by the Planning Commission this month. Mr. Pomerleu is currently building similar units adjacent to and directly to the east of the subject property within Kliever fake Fields 4th Addition, a replat recently approved by Elk River. According to Mr. Pomerlue, the Market for his units has been brisk and he desires to continue he success into the East Addition.
