1. Call Meeting to Order
Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission
was called to order at 6:30 p.m. by Chair Eric Johnson.
2. Pledge of Allegiance
The Pledge of Allegiance was recited.
3. Consider 6/24/14 Planning Commission Agenda
Moved by Commissioner Konietzko and seconded by Commissioner Larson-Vito to
approve the June 24,2014, Planning Commission agenda. Motion carried 5-0.
4. 5/27/2014 Planning Commission Minutes
Motion by Commissioner Konietzko and seconded by Commissioner Larson-Vito to
approve the May 27,2014, Planning Commission minutes. Motion carried 5-0.
5.1 Request by Spectrum Schools for Interim Use Permit for Wrestling Facility
located in Business Park Zoning District (extension of exiting Interim Use
Permit), Case No. CU 14-14 — Public Hearing
The staff report was presented by Zack Carlton. Staff recommended approval with the
conditions listed in the staff report.
Chair Johnson opened the public hearing. There being no public comment, Chair Johnson
closed the public hearing.
Motion by Commissioner Konietzko and seconded by Commissioner Larson-Vito to
recommend approval of the request by Spectrum School for an Interim Use Permit
for a wrestling facility and fitness classes located in the Business Park Zoning
District,with the following conditions:
1. The Interim Use Permit (IUP) shall expire on June 1, 2015, or when the gym
facility at 17834 Industrial Circle is no longer in use,whichever occurs first.
2. Additional extensions to the IUP will not be granted.
3. As an Interim Use Permit is not a Building Permit, the applicant shall obtain all
required permits, including approvals from the Fire Chief, City Engineer and
Building Official.
4. The standards for issuance of the Conditional Use Permit (CU 10-22) shall
continue to be maintained.
5. Due to the industrial nature of the neighborhood, the school recognizes that
noise, odors, truck traffic, and other undesirable effects may be present.
Motion carried 5-0.
5.2 Request by City of Elk River for an amendment to City's Land Use
Regulations regarding fences, Case No. OA 14-02 — Public Hearing
The staff report was presented by Chris Leeseberg.
Chair Johnson opened the public hearing. There being no public comment, Chair Johnson
closed the public hearing.
Commissioner Petschl asked what criteria triggered the need for a building permit for an
above-ground pool. Mr. Leeseberg stated that he did not recall the exact text,but noted that
the City's criteria is the same as the State of Minnesota (building code), and that if a building
permit is required, a fence is also required.
Motion by Commissioner Konietzko and seconded by Commissioner Petschl to
recommend approval of the request by the City of Elk River for an amendment to the
City's Land Use Regulations regarding below ground pool fencing. The motion
carried 5-0.
6. General Business —None
7.1 City Council Liaison Update
Councilmember Burandt updated the Commission on Council action taken on the May 27,
2014, Planning Commission items.
7.2 June 25th Parks and Recreation Master Plan Open House
Chris Leeseberg noted that an open house will be held on June 25, 2014 from 5:00 p.m. —
8:00 p.m. at City Hall to review the Parks and Recreation draft Master Plan.
8. Adjournment
There being no further business, Commissioner Konietzko moved to adjourn the
meeting.
