SUBJECT: Discuss Hunting Restrictions
Request
The Commission is asked to begin discussing the.City's hunting restrictions.
Specifically, the Commission is asked to consider and make a recommendation to the
City Council regarding allowing bow hunting within the city limits.

Analysis
The current city ordinance prohibits the discharge of dangerous weapons within 500
feet of any adjoining property, building, structure or the boundary of any platted area.
As illustrated on the attached No Hunting map, this area encompasses a large portion
of the city including platted areas in the Al and R1a zoning district. In recent years, the
City has received a number of requests to allow hunting within and near the Pintail Pond
area north of County Road #12. It is currently zoned Rte (east of Trott Brook Farm).
The attached No Hunting map also indicates in gray shading areas in which bow
hunting is currently allowed. The Commission is asked to consider the following
questions:
1. Should bow hunting be expanded within the City limits?
2. Should bow hunting be allowed within City parks?
3. If bow hunting is expanded within the City limits, what type of permits should be
required?
The Police Chief would prefer that if bow hunting is expanded within the City limits that it
be by permit only. This would require applicants to register with the City and require
IPwritten permission from a landowner prior to allowing bow hunting to commence. The

Commission could allow bow hunting within City parks and could limit the time period for
bow hunting in City parks.
Recommendation
The Commission is asked to discuss the merits of bow hunting within the City limits and
specifically, within City parks. A decision by the Commission is not required at this
meeting.

404.06 - SELLING OR FURNISHING A DANGEROUS WEAPON TO A M OR
The selling, giving, loaning or furnishing in any w of a
dangerous weapon to a minor under the age of eigh -en (18)years
without the written consent of his parent or • - dian, or of a
police officer or magistrate is hereby prohi• ited.
404.08 - HANDLING AND USE OF DANGEROUS `4• -ONS BY MINORS
Minors under the age of sixteen (16 years and over twelve (12)
years must have in their possessi ) while handling or using any
firearm a valid firearms safet certificate. No minor under the
age of fourteen (14) years s•=11 handle or use any dangerous
weapon except while in the •resence of his parent or guardian.
No minor under the age o eighteen (18) years shall handle or use
any dangerous weapon - •cept while in the presence of his parent
or guardian, or wit, the written consent of his parent or
guardian or of a -olice officer or magistrate.
404.10 - EXC' TIONS: LAWFUL DEFENSE AND LAW ENFORCEMENT
Nothing n this section shall be construed to prohibit the use or
disch- ge of a dangerous weapon in the lawful defense of persons
or • operty; or in the enforcement of the law by peace officers
-. d other law enforcement personnel.
404.12 - HUNTING AND SHOOTING, PERMISSION BY LANDOWNER
1 . Hunting or shooting upon land within the City of Elk River
may be conducted with the written permission of the landowner
except as prohibited in this Section 404.12 and except that no
permission shall be required for the owner of such land, or
members of the owner' s immediate family or guest in the company
of the owner of said land.
2 . The discharge or use of a dangerous weapon shall be
prohibited in the following locations:
A. Within one thousand (1, 000) feet of the ordinary high
water mark of Lake Orono or the Elk River:
B. Within five hundred (500) feet of any adjoining
property, building or structure or the boundary of any
platted area. This minimum 500 foot distance may be reduced
to two hundred (200) feet at an organized gun club as •
defined in Section 404.14 for the discharge of shotguns at a
trap range from a currently existing permanent shooting pad
directed away from the building or platted area.
C. On lands not zoned R-la, A-1, I-1 or I-2 except that the
same shall likewise be prohibited on lands zoned I-1 or I-2 •

if said zoning districts are contiguous on two (2) or more
40 sides by lands zoned R-lb, R-lc, R-2, R-3, R-4 or PUD;
D. On platted lands zoned R-la.
3 . Not withstanding the provisions of Section 404.12 (2) :
A. The discharge or use of "BB guns" , pellet guns and
slingshots in a safe manner by adults over the age of
eighteen (18) years, or by minors under the age of eighteen
(18) years who are under the direct supervision of their
parent or guardian, is permitted upon any land within the
City of Elk River with the written permission of the
landowner, except that no permission shall be required for
the owner of such land or for members of the owner' s
immediate family or guests in the company of the owner of
said land.
B. The discharge or use of dangerous weapons at indoor
target ranges which are operated in a manner to ensure that
projectiles are contained on the premises and within the
target range and so as not to endanger the life or safety of
any person and which are otherwise consistent with the
requirements of this Code of Ordinances is permitted in any
location within the City of Elk River. A projectile leaving
the premises upon which a target range is operated or a
.• person injured by a projectile fired at the said premises is
prima facie evidence of the target range being operated in
an unsafe manner and in violation of this Section 404.
C. The discharge or use of dangerous weapons at outdoor
target ranges which are operated in a manner to ensure that
projectiles are contained on the premises and within the
target range and so as not to endanger the life or safety of
. any person and which are otherwise consistent with the
requirements of this Code of Ordinances is permitted at any
location on lands zoned R-la (unless platted) , A-1, I-1, or
I-2 with the written permission of the landowner, provided
that the discharge or use of dangerous weapons at such
target ranges does not endanger or constitute a nuisance to
adjoining or nearby properties. A projectile leaving the
premises upon which a target range is operated or a person
injured by a projectile fired at the said premises is a
prima facie evidence of the target range being operated in
an unsafe manner and in violation of this Section 404 .
4. No rifles shall be discharged within the City of Elk River
except at indoor target ranges which are in compliance with
Section 404.12 (3) (ii) and at outdoor target ranges which are
operated in a safe manner, which are located on lands zoned A-1,
and which comply in all other respects with this Section 404.
For the purposes of this Section 404.12 (4) , "rifle" does not
include: (i) 22 caliber rim-fire rifles using 22 caliber short,
long, or long rifle bullets; (ii) smooth-bore muzzle loading

muskets of not less than 45 caliber and rifle muzzle loading
muskets of not less than 40 caliber that are incapable of being
loaded at the breech.
5 . Nothing herein shall prohibit peace officers from enforcing
the provisions of Minnesota law applicable to firearms or the
hunting of big or small game.
404.14 - ORGANIZED CLUB PERMIT
1. The City Council may issue, upon application, a speci-
permit to an organized gun club. Such permit shall al the

and guests subject to such conditions as m- . •e required by the
City Council to protect the public he safety and welfare.
2 . An organized gun club wh' - has received a special permit
from the City Council may otwithstanding the provisions of
Section 404.06 and 401 . 68, loan or furnish dangerous weapons to
minors under the - •e of eighteen (18) years to handle and use
weapons, pro ' .ed that said dangerous weapons may discharged
and used - said minors only on the club grounds and only under
the ect supervision of an adult club member or some other

SECTION 406 - WATER USE RESTRICTIONS
406.00 - WATER USE RESTRICTIONS

authorized to invoke water use restrictions in cases of emer -ncy
to ensure adequate water supplies to meet the health, saf- y, and
welfare needs of the City of Elk River and its residen Water
use restrictions shall be invoked by resolution of e Public
Utility Commission, and shall take effect immedi- ely upon
adoption of such resolution. The Public Util' Commission may
delegate to its general manager or water s -=rintendent authority
to impose temporary water use restrictio- until the Commission
can meet to consider a resolution. T penalties imposed below
in Section 406.01 may be invoked u•.n publication of the
resolution imposing restriction in the legal paper.
406.01 - PENALTIES
The first violation the restrictions contained in this
ordinance shall s. .ject the offending person, firm, corporation
or associatio o a written warning. A second violation of the
restrictio shall be a petty misdemeanor with a penalty of $50
and shal increase to the sum of One Hundred Dollars ($100) for
the t. 'rd violation. A fourth violation shall result in a water
sh -off with the reconnection fee to be paid by the offending
•roperty owner according to the policies of the Public Utilities

5.07.09 Use of Bows and Arrows. The use of a bow and arrow for hunting purposes
• shall be permitted in the City in hunting wild game in accordance with the laws of the State of
Minnesota. Bow and arrow hunting shall not be permitted within 300 yards of any residential
structure, commercial structure, park or playground and it shall not be permitted within 150
yards of any trunk highway.
5.0710 0 std Arrow Hrrutfng. A permit for bow and arrow hunting
shall-"be required prior to such hunting in the City. Applicants for a bow and arrow bunting
permit shall apply to the Ramsey City Police Chief or his/her designated representative. No
permit shall be issued until the applicant displays to the Chief of Police written permission from
the landowner where the applicant desires to hunt. Permits shall be issued only for the period of
the State of Minnesota bow and arrow annual deer hunting season.

other provisions of this ordinance."
