9.B.1.PRSR 06-14-2000 Item #9.B.1. ityof � Ak Ra• ver MEMORANDUM TO: Park and Recreation Commission ft FROM: Michele McPherson,'irector of Planning DATE: June 14, 2000 SUBJECT: Joint Powers Agreement with Independent School District#728 During the week of May 22"d, staff met with Dr. Flannery, Superintendent of Independent School District#728, Rick Foster of Riverside Development, and Daryl Thompson of Riverside Development, to discuss a possible joint powers agreement between the City, the School District and Riverside Development. The School District is currently searching for property in order to construct a new elementary school on the east side of Elk River. They have identified property one-quarter mile east of Trout Brook Farms on the north side of 181st Avenue for • a possible location for this elementary school (see attached map). This 40 acre parcel is owned by Riverside Development who also owns approximately 240 acres north of the subject property. The joint powers agreement proposes that the School District purchase 20 acres of land from Riverside Development to locate the elementary school. 16 acres of land would be dedicated and given to the City for park purposes as a pre-development dedication for the remaining 240 acres by Riverside Development. The City would then own the land which would be used probably for open fields which could then be utilized by the School District (see attached preliminary layout). Staff has already indicated to the developer that the 16 acres of pre-development land dedication would not be considered full dedication and that once the development is proposed, staff and the Commission would continue to look for additional land or fees to be paid to complete the 10 percent requirement. The proposed 40 acre parcel is crossed by a portion of Trott Brook. The area south of Trott Brook is currently farmed and is flat and predominately dry. The area north of and adjacent to Trott Brook is wooded and could be used for playground or picnic areas by the general public. A trail could be built along Trott Brook, connecting it to the trail system in Trout Brook Farms and would also have access to the reconstructed 181st Avenue, which is proposed to have widened shoulders and a detached trail adjacent to it and within the Trout Brook Park development. • S:\PLANNING MICHMC\PARKNREC\JOINTPOW.DOC 13065 Orono Parkway • P.O.
