SUBJECT: Park Dedication Fees and the Open
Space Preservation Development
Ordinance
Overview
On March 23, 1999, the Planning Commission gave their support for the
draft of the Open Space Preservation Development Ordinance. Presently,
cluster subdivisions are subject to the same park dedication requirements as
• conventional subdivisions, based on 10% land or a fee per dwelling unit. In
an effort to create incentives for developers and remove disincentives, an
idea regarding park dedication has surfaced. The idea is to have park
dedication requirements be based on the "yield plan;" the number of lots that
would be created under conventional development in the Rla or Al district.
By requiring dedication based on the increased density, a disincentive is in
effect created. Some cluster ordinances, such as Sherburne County's, have
exempted cluster subdivisions from park dedication requirements altogether
in exchange for open space preservation.
Request
That the Park and Recreation Commission make a recommendation to base
park dedication requirements on either the "yield plan" or the actual number
of lots created with density bonus.
