Canvassing Board to take the oath of office. 2. Adopt,by motion,the resolution approving the abstract of ballots cast. Once the Board signs the abstract resolution,the results become official. Background/Discussion Per State law the City Council serves as the Canvassing Board and must meet to canvas and declare the results on the third day after the primary. Attached is the abstract of the votes cast for precincts 4a and 4b for the Ward 4 Council seat. If the Canvassing Board approves the results and adopts the resolution,Jennifer Wagner and Paul Motin would be placed on the General Election ballot for November. Recount Information It is possible this race could have a recount. Minnesota election law authorizes administrative recounts after the Canvassing Board certifies the results. There are no longer automatic recounts for local municipal races. There are provisions for a publically funded recount. Following is the provision that would affect this race. Less than 400 total votes cast for the office: If the total numbers of votes cast for that election was fewer than 400, a losing candidate may request a recount of the votes cast, at the expense of the city,if the difference between the votes cast for that candidate and for a winning candidate is less than 10 votes. Candidates Motin and Chuba are separated by less than 10 votes. If a recount is requested,the Canvassing Board must meet after the recount to examine any challenged ballots and to certify the results of the recount. N c � � V 0 ° r in O N N � N 3) U o o ° r -a c o m a a CL c �� U q�O OU N tJ � City of Elk River Resolution 14- A Resolution of the City of Elk River Canvassing Election Returns and Declaring the Results of the City Primary Election Held August 12, 2014 WHEREAS, pursuant to MS §205.185 Subdivision 3 the City Council shall act as the Canvassing Board, canvass the returns, and declare the results of the election; and WHEREAS, the results are being presented in summary form to the Canvassing Board for its inspection; and WHEREAS, it appears from said returns and the canvass thereof attached Exhibit A outlines how the votes were cast; and NOW, THEREFORE, BE IT RESOLVED by the City=Council of the City of Elk River,Minnesota, as follows: the following candidates are hereby declared nominated to move forward to the General Election ballot for November 4, 2014, and the City Clerk's Office is instructed and directed to notifv them of their nomination.
