Open and close the public hearing. II. Approve,by motion,the Preliminary Plat for Natures Edge Business Center Second Addition. III. Adopt,by resolution,the Final Plat for Nature's Edge Business Center Second Addition,both with the following conditions: 1. Access control shall be deeded to MnDOT from Oudot A. 2. No additional drainage shall be routed to MnDOT right of way. 3. The development shall meet all applicable fire codes. The Fire Chief shall verify the location of all fire hydrants, and may require additional hydrants necessary to preserve the health and safety of the residents. 4. A wetland buffer of 25 feet applies to all wetlands and a structure setback of 20 feet from the buffer applies. An exhibit shall be prepared and included in the literature provided to potential buyers. 5. Wetland boundaries shall be posted as directed in Section 30-1852 6. In addition to the easements shown on the preliminary plat,the following easements shall be provided: a) A 25-foot easement adjacent to the outside edge of delineated wetlands to note, preserve and protect the required no-touch buffer. b) A 20-foot pedestrian easement adjacent to the 25-foot easement on the outside edge of the delineated wetlands to provide for the future construction of a pedestrian amenity. 7. P a w E R E U 6 Y Template Updated 4/14 INIM UREI Background/Discussion Case No. P 14-05 The Economic Development Authority and the City of Elk River propose the second phase of the Natures Edge Business Center. This phase will provide developable land in the Highway Commercial (C- 3) and Business Park (BP) zoning districts generally south of the first phase of Natures Edge Business Center. The City Council opened and continued the public hearing at their August 18, 2014, meeting to provide additional time for staff to complete minor modifications to the plat. Having resolved the wetland permitting issues and suggested adjustments to the Twin Lakes Road and 168th Avenue intersection, staff requests approval of the Preliminary Plat and Final Plat Resolution. Plat The plat creates five buildable lots and two oudots. One oudot is guided for a future interchange and is being retained until the access issues are better understood. Right-of-way for two roads,Twin Lakes Road and 168th Avenue, are included in the plat and identify locations for future connections. Lot 1, block 1, and lot 1,block 3,include wetlands that may be used for treatment of runoff from future development.Wetland buffering regulations require a 45-foot drainage and utility easement around the delineated edge of the wetlands. Within this easement there is a 25-foot wetland buffer strip and a setback of 20 feet for structures and pavement. Focus Area Study The FAST Study identifies this area for development as destination retail and jobs (light industrial). These uses require proximity to major roadways for access and visibility. Visibility is provided via proximity to Highway 10 and access will be provided with the future intersection of Twin Lakes Road and Highway 10. City plans identify Twin Lakes Road as a primary north-south alternative to Highways 10 and 169, and a primary highway connection will be just south of the proposed development. The right-of--way for the extension of Twin Lakes Road to Highway 10 is included in the plat,but only half of the boulevard will be constructed. Twin Lakes Road will terminate,temporarily, just south of the intersection with 168th Avenue. Planning Commission Public Hearing No one spoke during the public hearing and no comments have been received for or against the proposed plat. Planning Commission The Commission had no concerns when they reviewed the Preliminary Plat on July 22, 2014, and recommended approval 7- 0. Since the Planning Commission review, the plat has been modified slightly, to accommodate requirements of the Army Corp of Engineers (wetlands) and Northern Natural Gas (pipeline issues). These modifications did not significantly change the layout of the lots.
