A. Land Use Cases
1. Park in Trott Brook Farms
Grading has been finished in Trott Brook Farms. The curbing has been installed,
and paving should be completed by the end of next week. In January, we will
discuss shelter design and tot lot equipment for the park.
2. Status of Charest Mississippi Parcel
•
The City is in the process of pursuing prosecution of Mr. Charest under the nuisance
code. The defendant requested a jury trial that will not occur until February or
March 2000.
An appraisal has been ordered to determine the value of the land for condemnation
purposes.
We will continue to update the Commission as information becomes available.
3. Signalization of Proctor/County Road 1
The County has agreed to share in the cost of a traffic signal at the intersection of
Proctor and County Road 1. You may have observed that stop signs were installed
at this intersection the week of October 25, 1999. The signal will be installed in
2000. The County has also discussed a traffic signal at Proctor and School Streets.
B. Park/Trail Developments
1. Railroad Trail: Acquisition by Sherburne County
• Attached please find a news article regarding the acquisition of 34.8 acres of
railroad right of way from Burlington Northern by Sherburne County. As is
discussed in the article, the acquisition is not in contiguous pieces, but the
remaining miles to be acquired totals only 6.8 miles.

2. BMX Facility
The City Council approved the lease with the BMX group at its October 18, 1999.
They concurred with the Commission's recommendation of having the group use the
existing parking lot at the ERYAC fields. They also agreed with the proposed
location of the track.
3. Lions Park Parking
At its September 20, 1999 meeting, the City Council voted to limit parking at Lions
Park to two hours during school hours and while school is in session. This was
done at the request of the Police Chief. Chief Zerwas requested this action of the
City Council due to a pedestrian/car accident on School Street as well as numerous
close calls with the CSOs assigned to direct traffic during morning and afternoon
rush hours.
The Commission may recall that this was discussed in August and the Commission
voted to allow unlimited parking by high school students at Lions Park.
4. Community Recreation
Please refer to the attached memo from Pat Klaers, City Administrator, regarding
Community Recreation. Work is almost complete on the offices at Emporium, and
the website is up, so check out www.communityrecreation.com.
There have been some incidents at the Emporium, and staff and the kids have
established new ground rules for attendance at Emporium events (refer to attached
memo dated October 25, 1999).
5. Recreation Briefs
There were no recreation briefs in the Elk River Star News in the last month.

SUBJECT: Community Recreation Update
Community Recreation Program Supervisor Michele Bergh will be in
attendance at this September 20 meeting to provide the council with an
update on Community Recreation activities and on city recreation programs.
The Community Recreation Board meets the afternoon of September 20.
Attached is the agenda for this meeting. At its last meeting in August, the
Board requested, as part of its budget discussion, that the city allow its
employees to be officed out of Emporium, and stated that it would finance the
• capital expenses (up to $8,000) associated with these offices and signage. The
Elk River City Council agreed to this request in August, and quotes for this
work are being obtained by the Building Official. It is anticipated that these
improvements will be completed before the end of the year.
Regarding city recreation activities, the program receiving the most attention
is Emporium. The attendance figures on weekends have increased
dramatically. It seems like now that the facility is a year old and some of the
teens are taking "ownership" into the facility, that attendance is increasing.
This is especially true on weekend nights when live music is taking place.
Very few crowd control issues exist when the music is geared for age 16 and
under (ending at 10:00 p.m.). However, when music ends at midnight and
the kids are 16 and over, some crowd control issues are present and these
issues are being worked on by Michele and the Police Department. Having
too many people attend Emporium activities is a good challenge for staff to
address.

of Dayton will be withdrawing from the Joint Powers Agreement and terminating the City's
participation in the program.
The City Council at their meeting on August 10, 1999 asked that a letter of resignation
be sent to the board. This notice will serve as the 180-day notice required in the agreement

and our agreement will terminate on February 7, 2000.
I appreciate the amount of effort that both Jeff and Michelle have put into the
program to try to make it work in the City of Dayton.

SUBJECT: Emporium Update
Weekend activities at the Emporium continue to be popular and attendance when
bands are playing is increasing. However, with this increased attendance comes
"crowd control" type of issues that need to be appropriately managed.
Police, Administration, and Community Recreation staffs have met to discuss and
review issues at the Emporium. In order to address city (and parent) concerns
regarding activities at Emporium we are moving forward with the following:
• Improving the lighting at the Main Street entrance into Emporium
and along the parking lot curb at Emporium (the globe street lights).
• Early communication between Community Recreation and the Police
Department in order to assure that either reserves or officers are
available during music nights to patrol the parking lot to help enforce
the policy of no smoking on city property and the underage drinking
law.
• As Emporium is a "youth center" type of facility, we are limiting
attendance to ages 20 and under.
• Frequent patrol of the parking area by the on-site supervisors is
necessary in order to ensure that attendees are not infringing on Ron's
parking lot.
The staff meeting was held in part because of concerns about the mixing of young
adults and teenagers. Additionally, the age limit should result in almost all of the
attendees being from the school district area. Some older kids (young adults) from
outside our area have been attending the music/dance events. Michele Bergh held a
meeting with the Emporium youth group on Thursday evening (see attached
meeting summary). About 18 local teenagers participated and they felt that
• restricting attendance to only residents of the school district was too strong of a step
to take at this time and that the age restrictions should address our concerns. The

Topics: Future Events and Policies at Emporium
Issues to Cover:
Ages coming to events—band members want older people there for exposure. They play because they
want people to find out about them and if they are only playing for local kids, this limits the exposure. They
preferred not to have to set restrictions on the ages but if they had to, they felt that 13-20 yrs was a fair
compromise. 20 year olds cannot go to bars and that was why they felt it was okay. Most of the people
coming to watch the bands are approximately 16 yrs of age. They also want parents and people in the
industry who are over 20 to be allowed and they were okay with setting this up in advance so we would
know.
Local vs. non-local young adults—the students did not want to limit it to locals. They felt that people
should be judged on their behavior, not on where they are from. They understood that someone who doesn't
live around here isn't as personally invested in Emporium as they are and, yet, they could cause problems
that would affect how the public viewed the facility. They still felt that people should be allowed to come to
Emporium as long as they agree to follow the policies. They also felt that the age limits would limit the
number of people we see coming from other communities. Most young people do not have their own cars to
get wherever they want; they rely on friends or their parents to give them a ride.
Problems that have occurred/Future Prevention/Consequences—they all felt that the problems
occurring would not go away. However, there were ways to limit the problems and deal with them if and
when they occur. The agreed upon ideas are:
• Big poster with rules by the counter and on the door as you come in.
• Band must announce the rules before they start playing—this means each band has to repeat the
rules.
• Bands should sign a"contract" that explains the policies and expectations before they are allowed to
play and if they break that "contract" they are not allowed to play any more and they must leave.
One person signing from a band is okay and they are responsible for making sure that every one who
is a part of their group knows the rules. We will also hand other members the rules as they get their
wristbands.
• Problems that occur must be dealt with immediately and with the individual. There are no second
chances.
• Smelling or seeing alcohol is grounds for someone having to leave. You don't need to catch them
actually drinking it.
• • Have a contest to design a standard flyer that will be used for all events. This would become the
official flyer and poster for Emporium. The only things that would change on the flyer would be
what the event is and when it takes place. Schools, etc. would be told that these are the only

Request
It has been suggested that the Commission conduct a half-day retreat in early January.
The preferred date to meet would be Saturday, January 8, 2000. The site of the
meeting would be LaRosa's community room and the retreat would start at 8:30 a.m.
and end at approximately 12:30 p.m.
Potential agenda topics include:
1. 2000 Goals
2. Budget
3. Election of Officers
4. Master Park Plan Review Process
5. Commission's Role in Guiding Programming
6. Policies/Procedures for Non-Staff Agenda Items and Volunteer Projects
An alternate date of January 22, 2000 has also been suggested if the 8th does not work.
