Location The property is located on the west side of Highway 10 at the intersection with 171~ Avenue Attachments · Proposed Design Standards · Minutes from March 19, 2001 City Council meeting Overview On March 19, 2001 the City Council approved the Conditional Use Permit for Mississippi Ridge Planned Unit Development. Condition number 20 of that approval required that the Council approve the design guidelines for the commercial part of the PUD. The proposed design standards are similar to those approved as part of the Elk River Crossing. The guidelines include a list of acceptable exterior materials, lighting guidelines, signage requirements, and architectural features. Recommendation Staff recommends that the City Council approve the development standards for Mississippi Ridge Planned Unit Development. Fax:612-425-2823 Feb 5 '04 13:48 P. 02 MISSISSIPPI RIDGE Development Standards 1) Facades and Exterior Walls Facades should be articulated to reduce the massive scale and uniform impersonal appearances of large retail building~q and provide visual interest. Buildings should incorporate recesses, off- sets, pilasters or angular forms so that no uninterrupted length exceeds 50 feet. The wall projection or recess should be a depth of approximately 3% of the length of the uninterrupted building length. Buildings should have architectural features and patterns that provide visual interest at a pedestrian scale. The features should be an integral part of the building fabric, and . not be applied trim, graphics or paint. Variations to roof lines and cornice details should also be used to add interest to buildings. Fagade colors should be subtle, neutral or earth tone colors. The development shall use a consistent palate of materials and colors throughout. Facades of a building which are visible from adjoining properties or public streets shall include certain design elements found on the front facades. Predominant exterior fagade materials should include, but not be limited to, one or more of the following: · Brick · Native Stone · Tinted, textured, integrally colored concrete masonry units. Stucco · Tilt-up panels with exterior facades as referred to in the above standards. Predominant exterior building materials shall not include the following: · Smooth faced concrete block. · Smooth faced or raked faced tilt up concrete panels. They should incorporate devices such as canopies, overhangs, recesses/projections, arcades, raised parapets over doors, peaked roof forms, display windows, architectural details such as tile work and moldings which are integrated into the building design. Wall lighting fixtures shall be consistent with pedestrian and general site lighting. Gcncral parking lot lighting shall be at a height no greater than 30 feet. Poles and fixtures shall be of a design that compliments the street and general site lighting standards and fixtures, 4) ~rash Collection and Outdoor Stora_g.e. Loading docks, truck parking, HVAC equipment, and other service functions should be incorporated into the overall design of the building and screened from view of adjoining properties and streets. Trash compactors and dumpsters should be within an enclosure constructed of the same materials and colors as those used in the building. Outdoor areas used for the gale and / or display of seasonal inventory shall be permanently defined and screened with walls and / or fences and landscaping. Outdoor sales and display areas, except for garden centers, shall not exceed 5% of the ground floor area of the building. 5) Canopies Canopies located over pump islands are allowed provided the architectural design, colors and character of the canopy shall be consistent with the principle building on site. The fascia of the canopy shall not be illuminated. Canopy lighting shall consist of canister spot lights recessed into the canopy. No portion of the light source or fixture may extend below the bottom face of the canopy. Signs shall be an integral part of the overall architectural design of a building and the project, rather than contrasting with it. They must consist of materials and design which compliments the architectural elements of the building and project. Signs must not be visually distracting or tend to dominate by means of location, size, color or lighting. All signs shall be internally illuminated. All freestanding signs shall be setback a minimum of 10 feet from all property lines and shall not obstruct visibility or encroach in any drainage or utility easements. 7) Monument Signs for Freestandin~ Sites Each of the freestanding buildings within Mississippi Ridge will be allowed to have a freestanding sign. The freestanding sign mu,~t be a monument style with a maximum height of 10 feet and a maximum area of 100 square feet. The sign shall be constructed of brick or face brick and it may include decorative brick and / or decorative glazed block accents. (2) iNC. Fax : 612-425-2825 Feb S '04 iS:SO P. 04 8) Wall Signs for Freestanding Site~ Wall signs for each freestanding building must consist of individual letters and shall not have more than 1 wall sign for each pfi~nciple building, except that where a principal building abuts 2 or more public streets, 2 wall signs will be allowed. Awning signs and canopy signs, including canopies over gas pumps, shall be included as wall signs. Awning and canopy signs shall not be illuminated. The sign area shall not exceed seven (7) percent of the area of the building wall, including doors and windows, to which the sign is to be affixed. 9) Multi - Tenant Buildings 1 (One) Wall sign per tenant unless the building faces 2 (two) or more streets. If thc building faces 2 (two) or more streets each tenant can have up to 2 (two) wall signs. Wall signs will have individual letter height of not more than 24 (tWenty-four) inches. 10) Other Signs All other signage that may occur within Mississippi Ridge and not specifically mentioned herein shall comply with the City of Elk River Sign Ordinance. All requests which are not consistent with conditions, character and intent of the Mississippi Ridge ~UD may be denied by the city. 11) Landscaping All landscaping plans must be approved by the City of Elk River. The approved plans must include a functional underground irrigation system for the property. 12) Mail Boxes All mail boxes must bc consistent in material, size, color and shape as those mail boxes used by the Mississippi Ridge residential townhomes. 13) Seller Approval The Buyer must agree to an architectural review by Seller of all building(s) and site plan proposed for the property pr/or to the commencement of any type of construction on the property. Request b,v S&Z Enterprises for Preliminary Plat (West OaRs) for ] 78 Townhouse Units, Public Heorinq, Case No. P01-03 6,9. Request by S&Z Enterprises for Conditional Use Permit for Site Plan of Townhouse Development [West Oaks), Public Hearinq, Case No. CU 01-07 Mayor Klinzing noted that the applicant has requested that to postpone these items until April 9, 2001. Mayor Klinzing further stated that she would allow staff and the developer to make a short presentation and then take public comment, but would not close the public hearing. George Sanford, S&Z Construction gave a brief description of the proposed aevelopment of the area. Scott Harlicker also commented on the proposal. Mayor Kiinzing opened the public hearing. Kelly Barry, 14415 183rd Avenue NW, stated that he owns 1,700 feet of property along the western boundary of the proposed plat. He expressed his concerns regarding disturbing the wetland, reduced wildlife, clear-cutting of trees, the density of the development, and traffic. Leslie Johnson, 18285 Yankfon St. NW, indicated that the proposed plat borders her property. Ms. Johnson indicated her concern with the possibility of the townhomes not maintaining their value, the probability of sewer and water coming to her property, and the financial impact the property will have on her home daycare business as she will be required to put up a fence due to the development. Tim Sladek, 11448 190 lA Lane, Park and Recreation Representative, indicated that the Park and Recreation Commission requested that 8 units south of the loop road be removed for the purpose of park space. There were no further comments from the public. Mayor Klinzing noted that the public hearing would remain open until the April 9th meeting. COUNClLMEMBER KUESTER MOVED TO POSTPONE THIS ISSUE TO THE APRIL 9, 2001, COUNCIL MEETING. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE MOTION CARRIED 5-0. 6.10. Request by Scott Powell for Rezoninq from C3 to PUD, Public Hearinq, ZC 01-04 6.11. Request by Scott Powell for Land Use Amendment from HB (Hiqhway Business) to HB and MR (Medium Density Residential), Public Hearinq- Case No. LU 01-03 6.12. Request by Scott Powell for Preliminary Plat Approval/Mississippi Ridqe), Public Hearinq - Case No. P 01-06 Request by Scott Powell for Conditional Use Permit for Site Plan of Mississippi Ridae, Public Hearinq, Case No. CU 01-09 City Council Minutes Page 11 March 19, 2001 Michele McPherson indicated Scott Powell has requested a rezoning, land use amendment, preliminary plat, and conditional use permit for a mixed use planned unit development. The plat consists of 8 commercial lots and 22 town home units. The property is located west of Highway 10 from 170th to 1 73re Avenues. Ms. McPherson reviewed issues associated with the plat regarding existing conditions, environmental issues, lot sizes, roads, park dedication, uses, and setbacks. Michele noted that the Planning Commission recommended approval of the requests. City Engineer Terry Maurer talked about access issues and the position from MnDOT regarding Highway 10 access points. He noted that this is an opportunity to implement consolidation of access points on east Highway 10. The possible use of eminent domain by the city was noted. Mayor Kiinzing opened the public hearing. Scoff ?owell, applicant, noted his concern with flow and speed of traffic on Highway 10 and the dangerous condition of the ramp from 169 and Highway 101 onto Highway 10. Mr. Powell aJso stated his concern regarding the impact that extending the road to the south will have on the residents in the area. Ted Saxon noted that he is in favor of the proposal. He also indicated his concerns with the high speed limit on Highway 10. Roland Benson, of Hanlon Monument Companies, noted that he has sold his property to Mr. Powe[I. He gave a brief history of his company. Dwight Kirkeide, 11230 173rd Avenue, distributed a letter to the Council. There being no other comments for or against the matter, Mayor Klinzing closed the public hearing. Discussion was held regarding Kirkeide's entrance to his property. It was noted that he would be provided access and not be assessed for the access. Counciimembers Matin and Dietz questioned the need to remove the cul-de~sac and connect the road to 1 70th Avenue. City Engineer Terry Maurer suggested that a representative from MnDOT discuss these issues with the council at a later date. Councilmember Tveite questioned whether the residential residents have been notified. Terry Maurer indicated that not all residents would have required a notice. Mr. Maurer suggested a holding a meeting with the neighboring residents. COUNCILMEMBER TVEITE MOVED TO ADOPT RESOLUTION 01-19 AMENDING THE COMPREHENSIVE PLAN TO CHANGE THE LAND USE FROM HB (HIGHWAY BUSINESS) TO HB (HIGHWAY BUSINESS) AND MR (MEDIUM DENSITY RESIDENTIAL), CASE NO. ZC 01-04 WITH THE FOLLOWING CONDITIONS: THAT THE REZONING IS CONSISTENT WITH THE CITY'S COMPREHENSIVE PLAN AND ZONING ORDINANCE. THAT THE REZONING WILL NOT CREATE ADVERSE IMPACTS TO ADJACENT USES. o THAT THE REZONING WILL ALLOW A MIXED USE (COMMERCIAL AND RESIDENTIAL) DEVELOPMENT THAT CREATES A LOW-IMPACT RESIDENTIAL TRANSITION ZONE ADJACENT TO THE MISSISSIPPI RIVER AND EXISTING RESIDENTIAL PROPERTIES. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED. ALL COMMENTS AND CONDITIONS INCLUDED IN THE BUILDING AND ZONING ADMINISTRATOR'S MEMO OF FEBRUARY 27, 2001 BE INCLUDED AND ADDRESSED. 3. YALE STREET BE CONNECTED TO ZANE STREET ON THE NORTH. A DEVELOPERS AGREEMENT OUTLINING THE TERMS AND CONDITIONS OF THE PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS BE PREPARED AND EXECUTED PRIOR TO RELEASING THE PLAT FOR RECORDING. 5.
