Request
The Council is asked to conduct a public informational meeting regarding the Sherburne
County Justice Center expansion.
Overview
The proposed Justice Center expansion is comprised a two-story 120-bed jail expansion with
a training facility and gun range located in the addition's basement. Also included in the
expansion is a free-standing maintenance structure which will house the boiler and chillers
for the building, as well as a small area to store the grounds maintenance equipment for the
site.

History
In reviewing the files, the first Sherburne County facility was built on the site in 1979. The
initial building permit indicated a structure 250'x175' (43,750 square feet), two stories in

height. Since that time, multiple permits for a variety of interior alterations have occurred,
however substantial additions occurred in 1993 (15,981 square feet), 1999 (180 jail cells were
added), and the current request for additional 120 jail cells.
The proposed building addition includes areas within the existing administration offices that
will be remodeled that do not have exterior impacts.
Analysis
A site plan review analysis typically is conducted internally with staff from Engineering,
Building & Environmental, Fire, Police, Planning and Public Works. Issues that are typically
reviewed and evaluated include zoning requirements (setbacks, parking requirements,
landscaping), grading and drainage, utility connections, Fire Department access, and impacts
to adjacent properties.
The following is an analysis of the proposed expansion of the Justice Center in terms of staff
review.
Zoning Requirements
Setbacks
The property is zoned Business Park and guided light industrial. The Business Park building
setbacks are as follows:
Front yard- 35 feet;
Side yard - 20 feet;
Rear yard - 30 feet.
The building meets the above setbacks in the following way:
Front setback - 244 feet;
Side yard setback - 40 feet on the east and 183 feet on the west;
Rear yard setback - 72 feet
Parking setbacks in the Business Park District are as follows:
Front yard - 25 feet;
Side yard - 20 feet;
Rear yard - 20 feet.
The drive and parking isles have the following setbacks in the expansion areas:
Side yard - 32 feet on the east and 210 feet on the west
Rear yard- 20 feet

There is a portion of the entry drive in the northeast corner of the ske that does not meet
the setback requirement of 20 feet.
Parking
Offices must meet a parking ratio of one space for every 300 square feet of floor area;
however, the Justice Center has a large amount of square footage is dedicated to jail space
which would not generate parking spaces other than those for the maximum number of staff
on duty at any given time. The Development Regulations do not identify a parking ratio for
jail cells.
Per the architect's calculation, the administration building square footage is 151,037 square
feet, which generates a need of 503 parking spaces. There are a total of 400 jail cells (this
includes dormitory spaces), of which 360 can be double-bunked. The total number of
parking spaces after expansion will be 566 regular spaces and 17 handicapped spaces.
Landscaping
The City's ordinance requires one tree for every 40 linear feet of site perimeter. For the
Justice Center site, 103 trees would be required; 52 overstory, 26 ornamental, and 25
evergreen. A detailed landscape plan was not submitted, however, on a site inspection, the
following trees were observed: 67 overstory, 24 ornamental, and 16 evergreen.
In addition to the above number of trees, the ordinance requires that screening at 80%
opacity be provided for adjacent residential uses and zones. The County has installed a six
foot high black vinyl-dad chain link fence with slats along the east property line. In
addition, there are evergreen trees planted in the adjacent properties along the entire length
of the fence.
Grading and Drainage
As part of the expansion plans, the existing detention pond located in the southwest corner
of the site will be modified and expanded to contain the additional storm water generated
from the additional impervious surface. The comments in the March 17, 2004 City
Engineer's memo have been submitted to the applicant and revisions have been made to the
plan. The City Engineer verbally indicated that the revisions to the plan meet the City's
requirements, that there are no further issues to address regarding the drainage and grading
plan.
Building Materials
The building materials and design is consistent with the existing facility and this complies
with the Business Park building design standards.
A detailed lighting plan should be submitted for staff review.

Conclusion
The expansion plans as presented meet the Development Regulations of the City with the
exception that a few more ornamental and evergreen trees are required to meet the letter of
the ordinance. The County should also provide an asbuilt landscape plan for the City's files.

RE: SHERBURNE COUNTY JUSTICE CENTER EXPANSION
Dear Ms. McPherson:
As requested, we have reviewed the site civil portion of the Sherburne County Justice Center
expansion. The plans we reviewed were prepared by Loucks and Associates and were marked as
95 percent complete with a date of January 23, 2004. Based on our review and comments
received at the staff review meeting, we would offer the following comments:
A. Storm SewerlPonding
1. The existing storm drainage pond located in the southwest corner of the site is
proposed to be reshaped and moved slightly further west. In this move of the pond,
the proposed side slopes are proposed to be steepened from a 4:1 to a 3:1. Best
Management Practices, which the City has adopted and follows, requires that the
side slopes remain at a 4:1 slope. In addition, no drainage calculations have been
provided to determine first of all if the same capacity is provided in the reconfigured
pond, and secondly, if additional storage volume has been added for the additional
impervious area caused by this Justice Center expansion.
2. Much of the existing storm sewer system is being abandoned and removed to make
way for the Justice Center expansion. The revised storm sewer system is now
extended down the roadway on the east side of building around the south side of
the building and into the pond. The City has a 40-foot drainage and utility easement
along the east side and south side of the property. Within that easement is
contained trunk sanitary sewer and watermain. The sanitary sewer is approximately
18 feet deep. The new storm sewer placed on the east side of the road on the east
side of the building is within five feet of the sanitary sewer. We would recommend
that the storm sewer line be placed on the west side of the roadway to provide more
separation from the existing sanitary sewer.
3. There will be three new outlets into the reconfigured drainage pond. There is a
standard plate showing riprap at the outlet of these pipes. In addition, there should
be a Storm Water Pollution Prevention Plan (SWPPP) submitted with the project,
which would detail all of the sediment and erosion control along with turf
establishment requirements for the project. As you are aware, the City is in the

process of preparing a standard SWPPP for use on projects. If Sherbume County
desired, it would be appropriate to use the City's standard SWPP for this project.
Is there a setback requirement for ponding from property lines, parking lots, and
buildings? The proposed reconfigured drainage pond has 3:1 side slopes that begin
immediately adjacent to the property line on the west and parking lot and new
building on the east. We would strongly suggest that this is an undesirable
situation.
B. Sanitary Sewer/Watermain
1. There are two new proposed hydrants to be installed near the south side of the
Justice Center expansion: one on the east and one on the west. The proposed
hydrant on the east is situated on the south side of the new read surrounding the
expansion. We would recommend that that hydrant be moved to the north side of
the road.
2. Fire Chief indicated he thought there was an existing hydrant not shown on the
plans that would be approximately just north of the building expansion on the west
side. The fire department would like that hydrant relocated, or a new one placed if
that hydrant does not exist, on the green space behind the sidewalk between the
existing building and the expansion.
3. Water service and fire protection is proposed to be provided by six-inch water stub
from the existing eight-inch water line along the west side of the expansion.
4. Sanitary sewer service is proposed to be provided into both sides, east and west, of
the expansion. On the east side of the building, this is proposed to be accomplished
by constructing a new sanitary sewer manhole over the existing line with a six-inch
stub to the building. On the west side, there is proposed to be an eight-inch stub out
of an existing manhole extended northerly to a new manhole with six-inch stubs into
the west side of the Justice Center expansion and the south side of the new
maintenance building. Because City Ordinance requires each individual building to
have its own service, this entire line from existing sanitary sewer will have to be
considered a private service.
