SUBJECT: Consideration of an Ordinance Amending Section 2.52 (Regular
Meetings) of the City Code
The City' Council ~vishes to establish regular meetings on the first, second, and third
Mondays of each month. Currently our CiD, Code states that regular meetings shah be held
on the second, third, and fourth Mondays of each month. Before you tonight is an
ordinance to make this change to the CiD, Code.
ACTION REQUESTED
MoUon by Council to adopt the attached ordinance amending Section 2.52 of the Ciu, Code.

AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 2-52 OF THE CITY CODE OF ORDINANCES

The City Council of the City of Elk River does hereby ordain as follows:
Section. 2-52. Regular meetings.
Regular meetings of the council shall be held on the first, second, and third ~r~ c ....... ,

A RESOLUTION FOR THE CITY OF ELK RIVER
RESOLUTION APPOINTING A CONTACT DEPARTMENT AND
ASSIGNING DUTIES
WHEREAS regulations of the Health Insurance Portability and Accountability Act of
1996 (HIPAA), 45 CFR 164.530 (a), require the City of Elk River appoint one
department as the contact department.
· to receive complaints about any failure to comply with either the
policies and procedures or the privacy rules in general; and,
WHEREAS the Elk River City Council shares concerns over privacy of health data
protected by the Act and wishes to comply with the requirements of the law,
NOW, THEREFORE BE IT RESOLVED, the City Council of the City of Elk River,
Minnesota, hereby appoints the Finance Department as the contact department.

RESOLUTION APPOINTING A PRIVACY OFFICIAL AND ASSIGNING
DUTIES
WHEREAS regulations of the Health Insurance Portability and Accountability Act of 1996
(HIPAA), 45 CFR 164.530 (a), require the City of Elk River appoint one person as the privacy
official.
· to coordinate the employee's policies and procedures under HIPAA's privacy
rules,
· to monitor and decide any issues that occur under the rules; and
WHEREAS the City Council of the City of Elk River shares concerns over privacy of health
data protected by the Act and wishes to comply with the requirements of the law.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Elk River,
Minnesota, hereby appoints the Finance Director as the privacy official.
