Approve, by motion,the lot split request by Roger Derrick of Washington Street Investors,LLC for West
Oaks Third subdivision.
Overview
West Oaks Third was final platted in 2004 and contains 40 townhome units and one common lot (Lot
41). The applicant wants to purchase 12 of the 40 units and a portion of Lot 41 to construct three 4 unit
townhome structures. In order to do this,Lot 41 needs to be subdivided.
Background/Discussion

The subject property contains 40 townhome lots and Lot 41. The common lot was created to provide
property with common ownership for drainage, utilities, and transportation. This proposed subdivision
will not affect the existing utilities, easements,grading, drainage, or transportation infrastructure. The
property will continue to be managed by an association.
Lot 41 is being proposed to be split into Parcel A and Parcel B to separate Lots 29-40 (Parcel B) for the
applicant to purchase from the current property owner.
Park dedication has already been satisfied with this plat.

None
Mn Statute 15.99 deadline
The city must take action by December 1, 2014.
