RESOLUTION NO. 04- 10
A RESOLUTION AMENDING THE COMPREHENSIVE PLAN
TO CHANGE THE LAND USE FROM MR (Medium Density Residential)
TO HB (Highway Business)
Case No. LU 03-05
WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the
procedure for amending the Comprehensive Plan, and
WHEREAS, the Planning Commission held a public hearing on Tuesday, January
29, 2004, and made no recommendation regarding the Comprehensive Plan amendment
request for the property generally described as:
Outlot A, Brentwood and Lots 3 and 4, Block 3, Ridgewood East ya Addition
and,
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment
request and finds the following:
1. The conditions have changed to warrant a change in the land use. A traffic light has
been installed at the 197~h Avenue/Highway 169 intersection. Previously vacant highway
commercial land has been developed.
2. There are no other highway commercial opportunities along the Highway 169
corridor of substantial size to adequately compete with adjacent surrounding communities'
commercial sites·
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Elk River that the Land Use Plan be amended to change the property as described above
from MR (Medium Density Residential) to HI3 (Highway Business).
