CITY OF ELK RIVER
AN ORDINANCE AMENDING THE
CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTIES
AS DESCRIBED FROM R1C (SINGLE FAMILY RESIDENTIAL) TO PUD
(PLANNED UNIT DEVELOPMENT)
CASE NO. ZC 03-07
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. The duly adopted Zoning Map of the City of Elk River is hereby
amended to rezone the properties described as:
Outlot A, Brentwood and Lots 3 and 4, Block 3, Ridgewood East 3~d Addition
Section 2. The rezoning is being approved based on the following findings:
1. The proposed rezoning to PUD is consistent the land use designation of Highway
Business.
2. The times and conditions have changed to warrant the change in zoning to PUD. A
traffic light has been installed at the 197~h Avenue/Highway 169 intersection. There are no
other highway commerdal opportunities along the Highway 169 corridor of substantial size
to adequately compete with adjacent surrounding communities' commerdal sites.
3. Utilities can be extended to the site without requiring the non-sewered
neighborhoods of Ridgewood East 3~ and Brentwood to hook up to the same.
4. The subiect property has good highway visibility and, with a frontage road through
the development, could see traffic impacts to the Brentwood neighborhood reduced. The
design of the PUD, as well as the vegetation to be preserved and proposed screening, will
reduce the impact 'on neighboring residences.
Section 3. That this Ordinance shall take effect and be in full force from and
after the date of its publication.
