Ordinance 14 - 11
An Ordinance Amending Section, 30-796, entitled "Fences; visibility at
intersections and driveways" and Section, 30-1007, entitled "Accessory structures"
of the City of Elk River, Minnesota, City Code to Modify Agricultural Fencing
Requirements.
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1.That §30-796 (d)(2) of the City of Elk River Code of Ordinances shall be amended
to read as follows:
(d) General requirement for fences.
(2) Constrwhon and maintenance.
a. Every fence shall be constructed in a complete and substantial manner and of
materials reasonably suited for the purpose for which the fence is proposed
to be used.
b. Every fence shall be maintained in a condition of reasonable repair. No fence
shall be constructed or continue which is dangerous to the public safety,
health, or welfare as determined by the director of planning or their designee.
C. Electric fences, barbed wire fences and barbless wire fences shall be
permitted only in the A-1 and R-1a zoning districts when related to farming_;
but not its bathidai-y fenees,
SECTION 2.That 30-1007 of the City of Elk River Code of Ordinances shall be amended to
read as follows:

from any road right-of-way.
s Swimming pools. Swimming pools shall be setback a minimum of eight feet from
the side yard and rear yard lot lines and must comply with the required front yard
setback as this subdivision II. Swimming pools must comply with the fencing
requirements found in section 30-796.
SECTION 3.That this ordinance shall tape effect upon adoption and be published as provided by
law.

River Approving Notice of Sum-
mary Publication of Ordinance No.
14 -11, an Ordinance Amending
Section 30 -796, entitled "Fences;
Visibility at Intersections and Drive-
ways" and Section, 30 -1007,
entitled "Accessory Structures"
of the City of Elk River Minnesota,
City Code.
WHEREAS, on October 20,
2014, the Elk River City Coun-
cil adopted Ordinance No. 14 -11
amending Section 30 -796, entitled
"Fences; visibility at intersections
and driveways ", and Section, 30-
1007, entitled "Accessary struc-
tures"; and
WHEREAS, Minnesota Statutes,
Section 412.191, Subd. 4 allows
publication by title and summary in
the case of lengthy ordinances; and
WHEREAS, the City Council
finds that the following summary
will clearly inform the public on the
intent and effect of Ordinance No.
14-11; and
WHEREAS, a copy of the full text
of Ordinance No. 14-11 is available
for inspection by any person at the
office of the Elk River City Clerk,
13065 Orono Parkway, during reg-
ular business hours — 8:00 a.m. to
4:30 p.m., Monday through Friday.
NOW, THEREFORE, BE IT RE-
SOLVED by the City Council of the
City of Elk River, Minnesota, as fol-
lows: That the City Council, by at
least a four -fifths vote, authorizes
publication of the title and the fol-
lowing summary of Ordinance No.
14 -11.
Public Notice
During their October 20, 2014,
meeting, the City Council adopted
Ordinance No. 14 -11, an ordinance
amending Section 30 -796, entitled
"Fences; visibility at intersections
and driveways ", and Section, 30-
1007, entitled "Accessory struc-
tures".
In summary, Ordinance No. 14-
11 makes the following three (3)
changes to Sections 30-796 and
30 -1007 of the city code:
1. Allows the placement of elec-
tric, barbed, and barbless wire
fences on the property line in A -1
and R -1 a zoning districts.
2. Removes the requirement to
place livestock fencing 100 feet
from all property fines in R -1 b,
R -1 c, and R -1d districts.
3. Removes the requirement to
place livestock fencing five (5) feet
from all property lines in the R -1a
district.
