Action Requested
Recommend, by motion,approval of the ordinance amendment increasing maximum sign size for
permitted home occupations.
Background/Discussion
The city's sign ordinance was amended late last fall and modified permitted size requirements for each
district and sign type. The amendment did not regulate signs four square feet in sign area or below, other
than the required ten foot property line setback established for all signs.
Section 30-801 regulates home occupations,including permitted signage. The current ordinance limits
home business signage to two square feet. Staff proposes increasing the maximum sign size to four square
feet to reflect the changes made to the sign ordinance. The change improves consistency throughout the
ordinance and reduces time spent on code enforcement.

An Ordinance Amending Section, 30-80I, entitled "Home Occupations" of the City
of Elk River, Minnesota, City Code to Modify Sign Regulations for Home
Occupations.
The City Council of the City of Elk River does hereby ordain as follows:
SECTION 1. That§30-801 (c) (6) of the City of Elk River Code of Ordinances shall be amended
to read as follows:
(c) Permitted home occupations. Permitted home occupation permits shall be issued subject to the
conditions of this section, other applicable city ordinances and state law. A permit for a
permitted home occupation may be issued by the city based upon proof of compliance with the
provisions of this section. Application for the permitted home occupation permit shall be
accompanied by a fee as adopted by resolution of the city council. If the city denies a permitted
home occupation permit to an applicant, the applicant may appeal the decision pursuant to the
provisions of subdivision II of division 2 of this article. Permitted home occupations are
subject to the following criteria:
(6) Any sign or visible advertisement shall not exceed two four square feet in area and shall be
mounted flat on the outside wall of the dwelling.
SECTION 2. That this ordinance shall take effect upon adoption and be published as provided by
law.
