Action Requested
Adopt,by resolution, the summary publication of Ordinance No. 14-11, an ordinance removing setback
requirements for fencing related to agricultural/livestock uses.
Background/Discussion
Modifications to the city's ordinance regulating fences for agricultural/livestock uses adopted at the
October 20, 2014, City Council meeting were:
1. Elimination of the setback requirement for electric,barbed, and barbless wire fences in the A-1
and R-1a districts when related to farming.
2. Elimination of the 100-foot setback for livestock fences in the R-1b,R-1c, and R-1d districts.
3. Elimination of the 5-foot setback for livestock fences in the R-1 a district.
Due to the cost to publish the ordinance, staff has prepared a summary of the ordinance for adoption via
the attached resolution. The resolution fulfills all legal publication requirements as completely as if the
entire ordinance had been published.
The city attorney has reviewed the summary.
Financial Impact
Adopting the resolution for summary publication of the ordinance will save the city on publication costs.

Resolution 14-
A Resolution of the City of Elk River Approving Notice of Summary
Publication of Ordinance No. 14-11, an Ordinance Amending Section 30-796,
entitled "Fences; Visibility at Intersections and Driveways" and Section,
30-1007, entitled "Accessory Structures" of the City of Elk River Minnesota,
City Code.
WHEREAS, on October 20, 2014, the Elk River City Council adopted Ordinance No. 14-
11 amending Section 30-796, entitled"Fences;visibility at intersections and
driveways", and Section,30-1007, entitled "Accessory structures"; and
WHEREAS, Minnesota Statutes, Section 412.191, Subd. 4 allows publication by title and
summary in the case of lengthy ordinances; and
WHEREAS, the City Council finds that the following summary will clearly inform the
public on the intent and effect of Ordinance No. 14-11; and
WHEREAS, a copy of the full text of Ordinance No. 14-11 is available for inspection by
any person at the office of the Elk River City Clerk, 13065 Orono Parkway,
during regular business hours— 8:00 a.m. to 4:30 p.m.,Monday through
Friday.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River,Minnesota, as follows: That the City Council, by at least a four-fifths vote, authorizes
publication of the title and the following summary of Ordinance No. 14-11.
Public Notice
During their October 20, 2014, meeting,the City Council adopted Ordinance No. 14-11, an
ordinance amending Section 30-796, entitled "Fences;visibility at intersections and
driveways", and Section, 30-1007, entitled "Accessory structures".
In summary, Ordinance No. 14-11 makes the following three (3) changes to Sections 30-796
and 30-1007 of the city code:
1. Allows the placement of electric,barbed, and barbless wire fences on the property
line in A-1 and R-1a zoning districts.
2. Removes the requirement to place livestock fencing 100 feet from all property lines
in R-1b, R-1c,and R-1d districts.
3. Removes the requirement to place livestock fencing five (5) feet from all property
lines in the R-1a district.
