The property has frontage on both County Road 1 and 221st Avenue. The property is a mix of woods and fields. The woods are located along County Road 1 and the remainder of the Memo to Mayor & City Council/AS 04-01 April 19, 2004 Page 2 site are fields. There is single family residence on a 5 acre parcel to the south of the proposed 10 acre lot. The other surrounding property is owned by the applicant. Analysis The proposed 10 acre lot complies with the dimensional requirements of the A1 zoning district. It has 431 feet of frontage along County Road 1. The remaining 49 acres has frontage along 221~ Avenue. Sherburne County Public Works has reviewed the subdivision because it has frontage on County Road 1. The subdivision includes 50 feet of right-of-way for County Road 1. The 10 acre lot will utilize an existing field access for a driveway off of County Road 1. Gradin.q, Draina.qe and Utilities Grading, drainage and utility issues are addressed in the City Engineer's memo. Park and Recreation Commission The Park and Recreation Commission recommended park dedication in the form of cash for one lot. Recommendation Staff recommends that the City Council approve the administrative subdivision for Richard Thompson with the following conditions: 1. ALL COMMENTS OF THE CITY ENGINEER SHALL BE ADDRESSED. 2. PARK DEDICATION FEES FOR ONE LOT SHALL BE PAID PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING. 3. SURFACE WATER MANAGEMENT FEES FOR ONE LOT SHALL BE PAID PRIOR TO RELEASING THE SUBDIVISION FOR RECORDING. 4. ALL COMMENTS OF SHERBURNE COUNTY PUBLIC WORKS DEPARTMENT SHALL BE ADDRESSED. On March 17, 2004 Richard Thompson applied for and received an Access Permit to CSAH 1 for this ten acre parcel. There is an existing field access to CSAH 1 that will serve this property. We reserve the fight to eliminate this access to CSAH 1 when future development occurs and an interior street network is designed and available. At that time this access to CSAH 1 will be eliminated. Any redevelopment of Thompson Addition and/or the remaining acreage lying adjacent to it will then be required to access 221 st Avenue. Because of the CSAH 1 reconstruction project that is scheduled for 2005, Sherburne County will upgrade the driveway slopes as necessary and install new culverts at that time. Our preliminary right of way plat proposal for the reconstruction of CSAH 1 shows a 50' right of way planned for this segment. We require Mr. Thompson dedicated this right of way to Sherburne County in fee title. We are not opposed to the City requiring additional ROW for their future trail connections. We have advised the Thompson's to develop a comprehensive plan for development of their property because their options may become more limited with less road frontage. The position and placement of the house, septic and out buildings should be considered because of the future access issue. Richard D. As you are aware it is located on the east side of CSAH 1 north of 221st Avenue. It is essentially creating one ten acre lot from a larger piece of property. The subdivision does provide adequate right of way for CSAH 1, meets all the lot dimensional requirements and provides the necessary drainage and utility easements around the perimeter. We have also reviewed the legal description and found it to be correct. Therefore we would recommend approval of the Thompson Addition as presented.
