Background/Discussion Minnesota Statutes Section 429.101 authorizes the city to levy an assessment against a property for unpaid special charges. Four property owners have signed a "Petition,Waiver and Agreement for Payment of the Cost of Installation and Connection of, or Repairs to, Private Utility Lines and Assessment of Amounts Paid as a Special Charge Under Minnesota Statutes, Section 429.101" allowing the city to assess the charges incurred for installation and connection to city water and sanitary sewer lines. The total amount assessed for the four properties is $43,719.68. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota, as follows: The parcels and amounts listed on Exhibit A attached hereto, are correct and made a part hereof, are to be levied, and are to be certified to the Sherburne County Auditor.
