Background/Discussion
Minnesota Statutes Section 429.101 authorizes the city to levy an assessment against a property for
unpaid special charges.
Four property owners have signed a "Petition,Waiver and Agreement for Payment of the Cost of
Installation and Connection of, or Repairs to, Private Utility Lines and Assessment of Amounts Paid as a
Special Charge Under Minnesota Statutes, Section 429.101" allowing the city to assess the charges
incurred for installation and connection to city water and sanitary sewer lines.
The total amount assessed for the four properties is $43,719.68.

Resolution 14-
A Resolution of the City of Elk River Adopting and Levying Assessments for Costs
Incurred to Connect to City Water and Sanitary Sewer Lines
WHEREAS, Minnesota Statutes Section 429.101 authorizes the Municipality to levy an assessment
against the property for unpaid special charges; and
WHEREAS, all of the property owners have requested that the city allow them to connect to the
sanitary sewer and water lines which adjoin the property;and
WHEREAS, the property owners have signed a "Petition,Waiver and Agreement for Payment of
the Cost of Installation and Connection of, or Repairs to, Private Utility Lines and Assessment of
Amounts Paid as a Special Charge Under Minnesota Statutes 429.101" to allow the connection costs
to be levied as an assessment against their property;and
WHEREAS, state law does not require a public hearing or notice before levying such assessments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota, as follows: The parcels and amounts listed on Exhibit A attached hereto, are correct
and made a part hereof, are to be levied, and are to be certified to the Sherburne County Auditor.
