Approve,by motion, an extension to the lease for certain city property to the Boy Scouts.
Background/Discussion
The city is owner of property at 11857 1915` 1/2 Street. The improvements on this property include an
1,800 square foot garage used as storage for three Boy Scout troops.
The original lease, signed in 1994, terminates December 1,2014. The extension,drafted by the city
attorney's office, extends the lease for 15 years. Annual lease payments remain at one dollar,plus utilities,
insurance, and maintenance.
The Boy Scouts have signed the lease extension.

EXTENSION OF LEASE
THIS EXTENSION OF LEASE ("Extension") is made as of the Pt day of December,
2014, by and between the CITY OF ELK RIVER, ("Lessor"), and BOY SCOUT TROOP
NOS. 90, 99, AND I 11, BOY SCOUTS OF AMERICA, CHARTERED BY
AMERICAN LEGION POST 112, CHURCH OF ST. ANDREWS, ("Lessee").
WITNESSETH
WHEREAS, the Lessor and Lessee entered into a Lease ("Lease") dated July 29, 1994 for
certain Premises ("Premises") located at Lot 4, Block 1, Ridgewood East 2nd Addition in the City of
Elk River, County of Sherburne and State of Minnesota, street address 11857 191" '/z Street; and
WHEREAS, under the terms of the Lease, the Lease terminates as of December 1,2014;
and
WHEREAS, Lessor and Lessee desire to extend the term of the Lease pursuant to the
terms, covenants and conditions of this Extension.
NOW, THEREFORE, for One Dollar and other good and valuable consideration, the
parties hereto hereby agree as follows:
1. Extension of Lease. The term of the Lease is hereby extended for 15 years until
terminated according to the terms hereof.
2. Rent. The rent during the extended term of this Lease shall be One and 00/100
Dollar ($1.00) per year payable in advance beginning with January 1, 2015 and payable on the 1s`day
of each year thereafter. Lessor shall pay the "Additional Rent" as set forth in the Lease.
3. Termination. Notwithstanding any other term of the Lease or this Extension, the
Lease may be terminated by Lessor with or without cause upon ninety (90) days written notice to
Lessee. The Lessor shall give Lessee ninety (90) days written notice of its intention to terminate the
Lease which notice shall give an exact date of termination which shall be the last day of any given
month.

4. Insurance. Insurance requirements outlined in Section 8.3 shall be increased to Two
Million and no/00 dollars ($2,000,000) in respect to injury or death to a single person, and to the
limit of not less than Two Million and no/00 dollars ($2,000,000.00) in the respect to any one (1)
accident, and to the limit of not less than One Million and no/00 dollars ($1,000,000.00) in respect
to any property damage; (b) steam boiler insurance on all steam boilers,pressure boilers, or other
such apparatus as Landlord or Lessor may deem necessary to be covered by such insurance and in
such amount or amounts as Landlord or Lessor may from time to time reasonably require.
4. Terms and Conditions. All other terms, covenants and conditions of the Lease
shall remain in full force and effect to the extent that they have not been modified by this Extension.
