Adopt,by motion,the resolution amending Tri-CAP Agreement 14-07 for vehicle storage and
maintenance.
Background/Discussion
The city and Tri-CAP entered into a vehicle storage and maintenance agreement on June 2, 2104. At that
time,Tri-CRP's service hours were 7:00 a.m. to 5:00 p.m. Per the contract,the lessee has the option to
extend service hours from 6:00 a.m. to 6:00 p.m. with a 30-day written notice provided to the city.
Tri-CAP received approval from MnDOT to extend service hours and subsequently submitted the 30-day
notice to staff. The extended service hours will take effect January 1, 2015.
The attached resolution amends the contract to extend Tri-CRP's service hours from 6:00 a.m. to 6:00
p.m.

A Resolution of the City of Elk River Amending Agreement 14-07 between
the City of Elk River and the Tri-County Action Program, Inc.
WHEREAS, this Amendment is entered into on the 1"day of December, 2014, by and
between the City of Elk River ("Lessor"),and Tri-County Action Program,Inc. ("Lessee") a
Minnesota non-profit corporation,located at 1200 23rd Avenue South,Waite Park,MN
56387.
WHEREAS, the City entered into an agreement with Tri-CAP for the provision of transit
bus storage and maintenance services on June 2, 2014; and
WHEREAS, the Lessee's current`Hours of Operation'are 7:00 a.m. to 5:00 p.m.; and
WHEREAS, the Lessee has the option to extend service hours from 6:00 a.m. to 6:00 p.m.
with a 30-day written notice; and
WHEREAS, Lessee has provided a 30-day written notice to extend service hours from
6:00 a.m. to 6:00 p.m.; and
WHEREAS, the parties wish to amend the Agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River,Minnesota, as follows: Section 16: HOURS OF OPERATION is amended to read as
follows: Lessee will operate their business between the hours of 7:00 6:00 a.m. to 5.00 6:00
p.m. Monday through Friday. Lessee has the option to extend their sefvice hours from 6:00-
a.m. to 6:00 p.m. by providing to Lessor thifty (30) days pnof.
