A Resolution of the City of Elk River Amending Agreement 14-07 between
the City of Elk River and the Tri-County Action Program, Inc.
WHEREAS, this Amendment is entered 11Ito on the I" day of December, 2014, by and
between the City of Elk River ("J,essot"), and Tri-County Action Program, Inc. ("Lessee") a
Minnesota non--profit corporation, located at 1200 23rd AvCTIUC South, Waite Park, MN
56387.
WHEREAS, the City entered into an agreement with Tri-CAP for the provision of transit
bus storage and maintenance services on June 2, 2014; and
WHEREAS, the Lessee's current Hours of Operatiori'are 7:00 a.m, to 5:00 p.m,:; and
WHEREAS, the Lessee has the option to extend service hours from 6:00 a.m. to 6.00 p.m.
with a 30-day written notice; and
WHEREAS, Lessee has provided a 30-day written notice to extend service hours from
6:00 a.m. to 6:00 p.m.; and
WHEREAS, the parties wish to amend the Agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ijk
River, Minnesota, as follows: Section 16: H01JRS OF OPEA.A'FION Is amended to read as
follows: lessee will operate their business between the hours of 74)0 6:00 a.m. to -54-4(l 6:00
p.m. Monday through Friday. Lessee lias their, sef_i4e hours from 6:00
