1. Call Meeting to Order
Ptirsuant to due call and notice thereof, the special meeting of the F'Ilk liver Planning
Commission was called to order at 6:30 p.tn. by Chair Eric Johnson.

request as presented.

Motion by Commissioner Larson -Vito and seconded by Commissioner Crook to
recommend approval of the request by City of Elk Rivet for an Ordinance
Regulations regarding truck sales and service. Motion carried 6-0.

4.2 Request by City of Elk River for Ordinance Amendment to Section 30 of the
C'ity of Elk River Elk River L,and Use Regulations to add Focused Area Study
Business District, Case NoA 14-07 — Public Hearing
The staff report was presented by.,leremy Barnhart. lie stated that the amendment will
create a new district, and rezoning of the properties is a separate issue., He explained that the
Southern Twin Lakes Road Business District is a unique zoning district, with sub districts.
He noted that truck sales and service ordinance amendment which was just approved will be
added.
Mr. Leeseberg reviewed the spreadsheet, listing uses in the city's current zoning districts and
the proposed uses for the sub zones.
Discussion then followed regarding the uses in. the matrix where there was a discrepancy
between staff and the Plannitig Commission on classification of a particular use (i.e.,
Per pitted, Conditional or not allowed).
Chai.rJohnson opened the public hearing
Steve Rolilf, 12821 188'r'Avenue NW, representing Cornerstone Auto, asked if their new
I.-'-i.q Auto will be rezoned to the I firige subzone by this action. MT. Barnhart explalined that
the ordinance amendment creates the district and rezoning will be a separate action, tying
parcels to a particular zoning. lie stated lie anticipates rezonings will be done at the
December planning Corriniission mecfing. Mr. Ro,hlf submitted a written objection to the
elimination of auto, sales as a Conditional LJse in the Hinge zoning area. Mr. Barnhart noted
that staff will not be teconimending that existing PUD's be rezoned. Mr. Rohlf asked if
there would be individual notices sent for the rezonings. Mr. Barnhart stated no, Mr, Rohlf
stated asked if it is being recommended that auto sales are a Conditional Use in the Hinge.
Mr. Barnhart stated yes. Mr. RohIf state that was a welcome change from last month's
meeting. He stated that they, would not have been able to, get a dealership license for the Kia
site if it became a nonconforming use.
John Winston, 815 Wayzata Blvd, Wayzata, NI Vit, representing Scott Powell/Cornerstone
Auto — stated that this is a massive zoning project and it has been a huge concern what the
inipact would be on auto sales in the Hinge. fie stated that with the change frons not being
allowed to being allowed as a Conditional t3se, would have a big impact on. possible
expansion in the futare. Mr. Winston stated that he has had dialog with the city's attorney,
Peter Beck, regarding Lot 4, Block 1, Mississippi I�dge Second Addition, and they are
optirnistic their issues can be resolved,
Confunissioner Konietzko asked what the he prop,ertyi owner's intent was for Lot 4, Block 1.
Mr. Winston stated that it has always been a commercial site and the agreements with the
city reflect that designation. Fie stated that dowrizoning the property to residential would
have a serious impact on the property value, and sibmificant expenditures have been incurred
for the property to be commercial (sewer and water, taxes, etc.), He stated that a street is
now proposed to run through it. Mn Winston agairistated lie anticipates a satisfactory
resolution.

Mr. Barnhart stated that Lot 4, Block 1, Mississippi Ridge Second Addition is located in the
proposed River West Residential sub7one and they are not proposing to rezone any PUD
propettY, Mr. Winston stated that was comforting to hear.
There being no further public comment, Chair.johnson closed the public hearing.
Commissioner Crook asked for clarification Sauna uses and Multiple Family uses in the,
Office X7illager subzone, Mr. Bariihart explained that a Sauna use is an uncommon "stand-.
alone" use, as saunas are usually associated with health clubs or spas. fie discussed the inuiti-
farnily uses associated with business/cornmercial uses.
Motion by Commissioner Keffer and seconded by Commissioner Konietzko to
recommend approval of the request by the City of Elk River for and Ordinance
Amendment to add Focused Area Study Business District, as described in the sta
report to the Commission dated November 5, 2014. Motion carried 6-0. 1
Commissioner Petschl to adjourn the meeting.
