Adopt,by motion,a resolution acknowledging support for the Lake Orono Trail project.
Background/Discussion
Staff has identified an opportunity for partial funding of the Lake Orono Trail through the
Transportation Alternatives Program (TAP) administered through MnDOT.
A Letter of Intent was submitted in October by the city engineer and the city received a recommendation
in early November. The project was discussed and recommended by the Parks and Recreation
Commission at their December 10, 2014, meeting.
The trail is identified in the draft Parks and Recreation Plan on page 45 which states "provide trail access
along south side of Hwy 10 from Proctor to Orono Park when the Highway 10 bridge will be replaced
scheduled for 2017." The preliminary design of the new bridge includes a trail, and this project will make
trail access across the bridge to Orono Park possible.
TAP projects receive federal transportation funds for the construction,planning and design of trail
facilities for pedestrians,bicyclists and other non-motorized forms of transportation. The year of
construction for the TAP is Fiscal Year 2019 (July 1, 2018—June 30, 2019).
This project has not been discussed by City Council. Staff is recommending approval of the resolution to
complete the application requirements by the deadline date of December 30, 2014. Further discussion
and approval of funding for this project will need to be discussed by City Council in 2015.
Financial Impact
The City is requesting 80% of the eligible construction costs be funded through the TAP ($640,000). We
will need to provide the matching 20%local share currently recommended at$160,000. The exact
funding source for the city's share will need to be discussed later by City Council. In addition,local city
funds will need to be used for the engineering and administration costs estimated at$200,000. The total
project cost is estimated at$1,000,000.

A Resolution of the City of Elk River Supporting and Agreeing to Maintain a
Trail Segment along TH 10 from Orono Park to Proctor Road
Resolution of Support from Sponsoring Agency
BE IT RESOLVED that the City of Elk River is the sponsoring agency for a
"Transportation Alternatives" project identified as Take Orono Trail and has reviewed and
approved the project as proposed. Sponsorship includes a willingness to secure and
guarantee the local share of costs associated with this project and responsibility for seeing
this project through to its completion,with compliance of all applicable laws,rules and
regulations.
BE IT FURTHER RESOLVED that Michael Hecker, Elk River Parks and Recreation
Director,is hereby authorized to act as agent on behalf of this application.
Agreement to Maintain Trail
WHEREAS, The Federal Highway Administration (FHWA) requires states agree to
operate and maintain facilities constructed with federal transportation funds for the useful
life of the improvement and not change the use of right-of-way or property ownership
acquired without prior approval from the Federal Highway Administration; and
WHEREAS, Transportation Alternatives projects receive federal funding; and
WHEREAS, The Minnesota Department of Transportation (MnDffl) has determined
that for projects implemented with alternative funds, this requirement should be applied to
the project proposer.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River,Minnesota, as follows: the sponsoring agency hereby agrees to assume full
responsibility for assuring the operation and maintenance of property and facilities related to
the aforementioned Transportation Alternatives project.
