Action Requested
Approve,by motion,the preliminary plat and the resolution granting final plat with the following
conditions:
1. The portion of property,as shown on Exhibit A, shall be dedicated to the city for right-of-way
purposes.
2. Two trees shall be planted in the front yard as indicated in Section 30-934.
3. Park dedication shall be paid for one (1) dwelling unit at the rate applicable at the time the lot split
is released for recording.
4. Access restriction shall be placed along 185"'Avenue.
5. Services to the properties north of Lot 1,Block 1, Clark Addition shall not be allowed through
Lot 1, Block 1, Clark Addition.
6. Failure of the subdivider to submit the final plat within one year,unless a written request for
extension has been submitted and for good cause granted by the council, shall cause the
preliminary plat to become null and void. However,the subdivider may continue to final plat a
phase of the approved preliminary plat within one year of each phase in order to extend valid
approval of the preliminary plat
Background/Discussion
The applicant will be platting Oudot F of the Fox Haven Addition with a portion of the adjacent lot to
the north (75-131-1420) creating one new buildable lot.
Planning Commission meeting summary
No one spoke at the public hearing. The Planning Commission had no concerns and unanimously
recommended approval of the request.

Overview
The applicant will be plating Outlot F of the Fox Haven addition with a portion of the adjacent lot to the
north (75-131-1420) creating one new buildable lot. The Planning Commission is reviewing the
Preliminary Plat and the City Council will review both the Preliminary Plat and Final Plat.
Background/Discussion
The subject property is zoned R1b, single family residential,with minimum lot sizes of 12,000 square feet
if sewered and 1 acre if non-sewered. The property currently is non-sewered but services are available in
185th Avenue, south of Oudot F.
The subject property (south lot) is approximately 0.79 acres in size and shares a property line with a
property on the north (north lot) that is approximately 1.99 acres in size. The applicant is proposing to
purchase about.5 acres of the north lot and combine in with the south lot.
Drainage and utility easements, 5-10 feet in width,surround the south lot.

NATURE
The "new" smaller north lot meets the minimum lot size required for non-sewered property in the Urban
Service District. The north lot does not have city services available. If the north parcel were to be
further subdivided,it would need to have city services provided through the Naples Street right-of-way.
Analysis
Comprehensive Plan
The subject property has a Land Use designation of Residential.
Transportation/ Circulation
Approximately 0.04 acres of land shall be dedicated to the city for right-of-way purposes. This will
maintain a consistent width of Naples Street.
Driveway access to Lot 1 Block 1 shall not be allowed on 185 'Avenue and be limited only to Naples
Street.
Utilities
Water and Sanitation will be provided to Lot 1 Block 1 from the existing services in 185t'Avenue.
Services to the properties north of Lot 1 Block 1 Clark Addition shall not be allowed through Lot 1
Block 1 Clark Addition.
Landscaping
Section 30-934 (c) (2) states all open areas of a lot which are not used and improved shall be landscaped
with a combination of overstory trees, ornamental trees,coniferous trees, shrubs, flowers, and turf or
permitted ground cover materials. The minimum number of trees in the front yard is two. One tree
must be located in the boulevard area and shall be an overstory type tree. A second tree shall be located
in the front yard area. Overstory,evergreen,and ornamental tree species are permitted.
Parks
Section 30-392 (3) indicates lot splits shall be submitted to the Parks and Recreation Commission for
review of park dedication requirements.A recommendation should be forwarded to the city council for
consideration,along with the proposed subdivision.
The Comprehensive Park Plan does not indicate a trail corridor along Twin Lakes Parkway not any park
target area in the wider area.
Park and Recreation Commission Recommendation—The Parks and Recreation Commission
recommend park dedication shall be paid for one (1) dwelling unit at the rate applicable at the time the
lot split is released for recording. The 2014 rate for residential is $3,712 per dwelling unit.

Resolution 14-
A Resolution of the City of Elk River Granting Final Plat for Clark Addition,
Case No. P 14-08
WHEREAS, application has been made for final plat approval,pursuant to Section 30-374
of the Elk River City Code of Ordinances, of the property legally described on attached
Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, a preliminary plat of the Property was approved by the City Council on
December 15, 2014; and
WHEREAS, the proposed final plat is consistent with the preliminary plat as approved by
the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions set forth by the
City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River,Minnesota, as follows:
1. The proposed subdivision is consistent with Chapter 30 of the City Code of
Ordinances and conforms with all of its requirements.
2. The proposed subdivision is consistent with all applicable general and specialized
city, county,and regional plans including, but not limited to,the City's
Comprehensive Plan.
3. The physical characteristics of the site,including, but not limited to,topography,
soils,vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and
drainage are suitable for the type and density of development and uses contemplated.
4. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services, facilities and
improvements otherwise required herein.
5. The proposed subdivision will not cause substantial environmental damage.
6. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.

7. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.
8. Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
9. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with,to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
10. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
11. This final plat approval shall expire two years from the date of this resolution if the
final plat is not recorded within that time.
