If a recommendation of approval is recommended, staff suggests the following conditions: 1.The Conditional Use Permit is not a building permit and the applicant must apply for and receive approval of required building and sign permits before construction may begin. 2.The building shall meet all building and fire codes. 3.The applicant must apply for and receive approval of all required sign permits before signage may be installed. 4.All comments of the City Park Planner/Planners comment letter dated January 22, 2015 shall be addressed. 5.The outdoor storage area shall be completely enclosed with a six foot tall privacy fence. 6.There shall be no storage of any materials and/or products on the property outside of the outdoor storage area. 7.Materials shall not be stacked higher than six (6) feet in the outdoor storage area. 8.If the outdoor storage area is to be increased more than 20,000 square feet, an amendment to the Conditional Use Permit shall be required. 9.All sources of artificial lights shall be so fixed, directed, designed or sized that the minimum subtotal of their illumination will not increase the level of illumination on any nearby residential property by more than 0.1 footcandle in or within 25 feet of a dwelling or by more than 0.5 footcandle on any part of the property. 10.A parking layout shall be provided to include in the City Council staff report. 11.An updated landscape plan shall be provided to include in the City Council staff report. 12.Submittal shows calculations for rate control of stormwater discharge from new impervious surface. Calculations also need to show volume control (no increase in post construction volume) 13.Applicant needs to show calculations demonstrating that 1.1” of rainfall over the new impervious area is infiltrated in the new basin. (to achieve pollutant load reduction) 14.Applicant needs to submit a long term maintenance plan for the new infiltration basin. (instructions on how and when the infiltration basin will be maintained) Overview Distinctive Iron wishes to locate their existing business to a 13,000 square foot building at 19128 Industrial Boulevard. Distinctive Iron is a manufacturing business that designs, fabricates, and installs structural and miscellaneous steel products, currently located in Nowthen. Background/Discussion The subject property has an existing 13,000 square foot facility in which the applicant would like to utilize 3,000 square feet of for office space and use the remaining 10,000 square feet for manufacturing. They are also proposing enclosing approximately 20,000 square feet of property with a six foot high chain link fence for outdoor storage. The manufacturing is a permitted use but the outdoor storage is the reason for the Conditional Use Permit (CUP). The property is zoned I1 (Light Industrial) where outdoor storage requires a CUP. The outdoor storage will be used to store steel material on racking that will not exceed six feet in height. In addition to screening the outdoor storage with chain link fencing and privacy slats, the applicant is proposing new landscaping. The proposed privacy slats will be a neutral color that will complement the building color. Applicable Regulation The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. 2. Will be consistent with the comprehensive plan. 3. Will not impede the normal and orderly development and improvement of surrounding vacant property. 4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. 5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. 7. Will fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license or permit to establish and operate the proposed use in the city. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. Analysis Comprehensive Plan The subject property has an underlying land use of Industrial. This use includes all forms of businesses with manufacturing, distribution, warehousing, or other industrial use and is commonly referred to as Light Industrial, Medium Industrial, or General Industrial. Building Materials Other than painting, no exterior building modifications are being proposed. The building will be painted a neutral color and the privacy slats in the chain link fence will be a complementary color to the building. Where screening is required, the city historically requires more substantial screening: wood or plastic fencing, shrubbery, and berming. Parking/Circulation While the submitted aerial does not show parking stall markings, the narrative indicates there are 44 existing parking stalls on the property. The attached Google Maps aerial shows 58 stalls. The parking requirements are that the facility as proposed provides 36 parking stalls. Staff has requested that a proposed parking layout be provided. Grading/ Drainage Stormwater runoff from this site is subject to the requirements of the MPCA issued City NPDES MS4 permit. This permit prescribes the need for the applicant to provide the following: 1)Submittal shows calculations for rate control of stormwater discharge from new impervious surface. Calculations also need to show volume control (no increase in post construction volume) 2)Applicant needs to show calculations demonstrating that 1.1” of rainfall over the new impervious area is infiltrated in the new basin. (to achieve pollutant load reduction) 3)Applicant needs to submit a long term maintenance plan for the new infiltration basin. (instructions on how and when the infiltration basin will be maintained) Landscaping Per ordinance, 34 trees are required. In situations where the landscaping requirements are not met, the city has required modifications in scale with the proposed business. Staff recommends that a total 15 overstory trees be added. Staff has requested that an updated landscape plan be provided. The landscape plan (L1) shows six trees graphically but the key markers show five. Lighting Staff has asked for clarification if the outdoor storage area will have lighting. Located at 9021 Viking Blvd, Nowthen, MN, this family owned and operated manufacturing business designs, fabricates and installs structural and miscellaneous steel products. Currently operating out of a 5,200 sq. ft. building, the Hemmer's are eager to take their business to the next level, and are looking to relocate and move to an existing 13,000 sq. ft. building on 19128 Industrial Blvd. NW. Distinctive Iron is open Monday through Friday, from 7am -4pm and operates one shift. With over 30 years of experience, Distinctive Iron prides themselves in exceeding customer's expectations in design, fabrication and project management in a quality- driven environment at a competitive price. Recent project include the expansion of Alliance Machine (Elk River) and LIMA Precision Machining (Zimmerman). The business currently employs a total of eight employees and is looking to hire an additional five employees, within the next two years. They hold various professional association certifications, and are proud sponsors of the Special Olympics, Susan G. Komen Breast Cancer Foundation and Eric Applen Children's Cancer Fund. Proposed project and location Distinctive Iron is proposing to move into 19128 Industrial Blvd. in Elk River. The building is 13,000 square feet total; 3,000 square feet will be used for office, and the remaining 10,000 for manufacturing. There are currently 44 existing parking stalls on the property. The company requires outdoor storage and is proposing to build a 6' tall chain link (with privacy slats) fence to enclose approximately 20,000 square feet of outdoor storage. Storage space will be used to store steel, located on wracking within the fence. The steel stacking height will not exceed 6'. In addition to screening the storage with fencing, the company is proposing additional landscaping, as requested by staff and outlined on the attached landscape plan. The proposed privacy slats will be a neutral color, and the company will be painting the building a neutral color to compliment the fence color. The company plans to maintain the fencing on a regular basis to ensure it remains aesthetically pleasing.
