Overview
At the May 13th, 1998 Parks and Recreation Commission meeting, Planning
Assistant, Scott Harlicker reviewed concept plans Hillside Estates Eighth
and Ninth Additions submitted by Phoenix Enterprises (Rick Foster). After
some discussion, the Commission requested that a 4 - 5 acre usable parcel be
dedicated for park purposes which is relatively flat, which backs up to the
trail corridor (power line easement), with easy off street access and does not

adjoin resident's back yards. The Commission also requested that the power
• line and gas line easements be maintained.
The preliminary plat proposal for Hillside Estates Eighth and Ninth
Additions are virtually unchanged from May 13th. No additional park space
or trail corridor space has been shown.
Previous Hillside Estates subdivisions required cash except for Hillside Fifth
Addition when the current 3.75 acre park was dedicated. The Planning
Department's park concept development efforts have demonstrated the need
for more flat open space in Hillside as well as public use of the power line and
gas line corridors.
Park Dedication
The Subdivision Ordinance requires 10% of the undeveloped land proposed to
be subdivided be set aside and dedicated to the general public as open space
for parks.
Phoenix Enterprises proposes to subdivide 105.89 acres and 10.58 acres of
park would meet the 10% park dedication requirement. The power line and
gas line corridors are roughly 14 acres if maintained in their entirety.
• Recommendation
Staff recommends that the Parks and Recreation Commission recommend the
following:
1. THAT 4-5 ACRE USABLE PARCEL BE DEDICATED FOR PARK PURPOSES
WHICH IS RELATIVELY FLAT,WHICH BACKS UP TO THE TRAIL CORRIDOR
(POWER LINE EASEMENT),WITH EASY OFF STREET ACCESS AND DOES
NOT ADJOIN RESIDENT'S BACK YARDS.
2. THAT THE POWER LINE AND GAS LINE CORRIDORS BE MAINTAINED AS
PUBLIC OPEN SPACE FOR TRAILS.
3. THAT A TRAIL BE LAID-OUT (GRADING PLAN)THROUGH THE POWERLINE
AND GAS LINE CORRIDOR WITH SLOPES NOT GREATER THAN (8%)EIGHT
PERCENT.

SUBJECT: PARKS AND TRAILS IN THE PROPOSED
PLAT OF HILLSIDE ESTATES
Mr. Rick Foster of Oxbow Properties is in control of 53 acres
of property, which he intends to develop. There is a map
included with this memo showing the position of the 53 acres
within the City limits .
Also included with this memo is a proposed preliminary plat
showing the layout of the lots within the 53 acres . On that
preliminary plat , Mr. Foster is proposing to develop blocks 3
and 4 now, and blocks 1 , 2, 5 , 6, 7 and 8 sometime in the
future. Blocks 1 and 2 are proposed by Mr. Foster to be
commercial sites . That property is not currently zoned
commercial .
The next map included with this memo is a sketch plan for the
III development of the remaining vacant property east of Highway
169 , north of Deerfield 3rd Addition and south of Deerfield 2nd
Addition. Mr. Foster did this sketch plan to show that his
development now will fit in with future development . This
overall sketch plan is what staff recommends you review when
deciding on a recommendation for parks and trails in this area.
Referring you to the comprehensive park system map, there is a
proposed east/west trail and a north/south trail identified on
the property shown on the sketch plan. There is also a future
neighborhood park identified in this area. The following are
issues that staff feels the Park & Rec. Commission should
comment on:
EAST/WEST TRAIL
193rd Lane proposed on the preliminary plat is being
recommended by staff to be a semi-collector street . This road is not proposed to be as wide as a typical collector street
because of concerns with hills and eliminating trees . However,
it would be wider than a normal residential street . This road
will run from Highway 169 on the west to Tyler Street on the
east in the future. Staff feels this is the most logical
location for the east/west trail .
The developer is proposing to include as part of this roadway
• an 8 ' to 10 ' wide bike lane. You should discuss whether this
bike lane is sufficient or if a sidewalk should also be
included along this roadway. The one concern with a sidewalk
is the elimination of more trees to accomplish it . You should

also discuss whether the bike lane and/or sidewalk should run
all the way to Highway 169 passed the proposed commercial
area . I personally feel that the trail system should go to
Highway 169 in this location giving pedestrians and bicyclist a
signalized crossing of the highway.
NORTH/SOUTH TRAIL
The developer is proposing that the north/south trail be
located along the powerline easement identified on both the
preliminary plat and the overall concept map. Staff agrees
with this alignment, which would bring this trail approximately
opposite the access into the City park in Deerfield 2nd
Addition. This alignment also avoids the additional removal of
trees to accomplish the trail, since the powerline has already
made a gap through the woods .
Staff also recommends that this trail terminate on the south
end at 193rd Avenue, where it would pick up the east/west
trail . Going further south past 193rd Avenue you run into a
swamp. Still further south, past the southern boundary of the
proposed plat, you would run into ownership problems . A
north/south access from Deerfield 3rd Addition could possibly
be a sidewalk along the proposed Carson Street . Staff
recommends that the north/south trail is improved. I
• personally feel that it should be a bituminous bike path, the
first leg of which should be improved when the 2nd phase of the
residential portion of Mr. Foster' s plat is developed.
FUTURE NEIGHBORHOOD PARK
On the overall sketch plan you will note the developer' s
proposed location for the future neighborhood park. The
developer is in negotiation with the owner of this property to
purchase it. He does not, however, have control of the
property at this time. You will have to decide whether or not
to recommend this future neighborhood park be in either the
first two residential phases or if it waits until future
development allows for the park to be located as proposed by
the developer. The proposed future park has a small pond on it
that could be used for ice skating and has a hill that could
possibly be used for a sliding area. This future park is also
the proposed location of a future watertower and has a
powerline running through it . A trail connection is proposed
to be provided from the north/south trail to this proposed park
area.
Staff recommends that we collect park dedication fees for the
first two phases of development and wait for a future
development to locate the neighborhood park.
• If possible, I would like the Park & Recreation Commission ' s
comments the week of the 13th of April so that they can be
added to the Council ' s preliminary plat review of this request
on April 20 , 1992 . Thank you.

SUBJECT: HILLSIDE ESTATES PARK DEDICATION
REQUIREMENT
Park Dedication requirements are included with all plats that
are approved by the City Council. The park dedication
requirement can be met by either providing cash to the City for
park development or by providing park land within each plat.
In this regard, the City Council must make a decision on the
park dedication requirements for Phase I of the Hillside
Estates Plat.
This issue has been reviewed by the Park and Recreation
Commission at its March and April meetings . The City Council
was present at the April meeting when this issue was discussed
and, accordingly, should be familiar with the issues involved.
At this time, the City is looking to obtain cash in lieu of
park land for the Phase I part of this project. In the total
development of this area, the City will be looking for park
S land but this will happen in a later development phase.
Additionally, a collector street is included in the plat and
part of the City trail system will be developed in this area.
It is proposed that the trail will be developed along the north
side of 193rd in the right-of-way and also along the eastern
street in Phase I for the north-south linkage that will
eventually get into the park in the Deerfield II development.
Attached for your review are the draft minutes from the April
13, 1992, Joint City Council and Park and Recreation Commission
meeting where a recommendation from the Commission was made on
this issue. The motion included in this section of the minutes
reflects staff recommendation and it is recommended that these
requirements be included when the City Council considers this
plat.

• 7. Discussion on Hillside Estates Plat
Pat Klaers indicated that Rick Foster's Hillside Estates Plat was
reviewed by the Commission at the March meeting. Pat Klaers stated
that the Park Master Plan shows a neighborhood park in this area. He
indicated that the recommendation for Phase I is to collect cash for
park dedication fees and to use the dedicated right-of-way for the
first part of the trail. He further indicated that the Commission
should be looking at different types of park opportunities for this
area.
Discussion was held regarding a future 10 foot wide bike lane/trail on
the north side of the east/west street corridor (193rd Avenue) . The
City Administrator indicated that the developer must provide the
right-of-way and will be required to grade the area. He further stated
that the dedication of the right-of-way for a transportation collector
street is not substitution for park dedication fees.
Chairman Anderson suggested raising the $350 per acre park dedication
fee. Pat Klaers, City Administrator, stated that this issue could be
discussed at a future Park and Recreation Commission meeting.
Commissioner St. Dennis suggested staying away from the power line
• easement suggested for the north/south section of the trail system as
it may cause problems in the future and to use the street right-of-way
in this area.

7.d. Barsodv Hills Preliminary Plat
Dynamics Design & Land Company has requested preliminary plat approval to
subdivide approximately 92 acres located on the north side of Brook Road and
217th Avenue into 8 residential lots. The majority of the property was formerly a
gravel mine with an existing farmstead that will remain on a 30 acre parcel. The
remaining 7 lots range in size form 4 acres to 12.5 acres.
It was the consensus of the Commissioners to accept cash as payment of the
park dedication requirements.
7.e. Hillside Estates 8th &9th Concept Plans
Planning Assistant Scott Harlicker reviewed concept plans for Hillside Estates 8th
and 9th Additions submitted by Phoenix Enterprises (Rick Foster). Discussion
followed regarding park needs for this area. It was the consensus of the
Commissioners to request that a 4-5 acre usable parcel be dedicated for park
purposes which is relatively flat,which backs up to the trail corridor,with easy off
street access and does not adjoin residents' backyards.The Commissioners also
requested that the powerline and gasline easement corridor be maintained.
Commissioner Anderson requested that the large park plan map be available at
all future Park and Recreation meetings.
8. Area Recreation Update-Jeff Asfahl
• Community Recreation Director Jeff Asfahl reviewed the following issues with the
Park and Recreation Commissioners as outlined in his memo dated May 13th:
-MASC Sports & Recreation Grants Program
-Skatepark development
-Youth Athletic Complex grand opening
-Youthbound
-Summer recreation program
-Youth Athletic Complex guidelines
9. Bond Referendum Discussion
a. Update- Decision Resources (Commissioner Kuester)
Chair Anderson indicated that Decision Resources is compiling the responses from
the survey regarding the park referendum. Preliminary results indicate the
following:
-Verifies the reasons for the referendum failure
-Including a pool in the next referendum may increase the chance for success.
-There is less chance for approval on a second referendum
