Overview • Staff surveyed 19 cities in regards to their park dedication fees. The survey shows a variety of approaches to park dedication fees with some greater than and some lesser than Elk River. Overall, the results are difficult to interpret due to the great difference in the cities surveyed. The cities surveyed have varying amounts of developable land and varying needs for parks and park improvements. Elk River Subdivision Ordinance There exists currently an inconsistency in the Subdivision Ordinance, section 1008.18 and how the City actually conducts its determination of cash dedications for parks. The subdivision ordinance states that ten percent of the proposed plat or cash equal to the fair market value of the undeveloped land be dedicated for parks. The ordinance reads as follows: 1008.18 -DEDICATION OF LAND OR CONTRIBUTION OF CASH FOR PUBLIC PURPOSE 1. In every plat, replat or subdivision of land to be developed for residential, commercial, industrial, or as a planned development which includes such uses or any combination thereof, as general rule, it is reasonable to require Ill that an amount of land equal in value to ten percent (10%) of the 13065 Orono Parkway • P.O. Box 490 • Elk River, MN 55330 • TDD&Phone: (612) 441-7420 • Fax: (612)441-7425 Memo to the Park and Recreation Commission October 14, 1998 Page 2 • undeveloped land proposed to be subdivided shall be set aside and dedicated by the tract owner or owners to the general public as open space for parks, playgrounds, trails, or public open space; or, at the option of the City, the tract owner or owners shall contribute to the City an amount of cash equal to the fair market value of the undeveloped land otherwise required to be so set aside and dedicated, or set aside and dedicate a part of such land and contribute the balance of such undeveloped land value in cash. The City Council shall determine the amount to be required by resolution from time to time. Any monies so paid to the City shall be placed in a special fund and used only for the acquisition of land for parks, playgrounds, trails, public open space and development of such areas and sites, and for debt retirement in connection with land previously acquired or developed for such public purposes. For purposes of this Ordinance, "fair market value of the undeveloped land" is defined as the fair market value of the land within such plat, replat, or subdivision as of the date the plat, replat, or subdivision is presented to the City Council for approval of the final plat, as determined by the City Assessor in the same manner as he determines the fair market value of land for tax purposes. 2. In addition, in every plat, replat, or subdivision of land to be developed for residential, commercial, industrial or as a planned unit development which includes such uses, the land required for public streets, regional storm water holding ponds and wetlands shall be set aside and dedicated on the • plat by the owners to the City. These areas will not be credited towards any park dedication requirements. The City currently conducts its park dedication requirements based on a ten percent of the land or a fee per dwelling unit as stated in Resolution 95-87. The City ordinance should have language in it that reflects how the park dedication is actually determined. Furthermore, additional language should be added that reflects the expectations of land dedicated for parks. Additional language for consideration include: Land to be dedicated shall be reasonably suited for its intended use as determined by the City and shall be at a location convenient to the public to be served. Factors used in evaluating the adequacy of proposed park and recreation areas shall include size, shape, topography, geology, hydrology, tree cover, access and location. III • f:\shrdoc\planning\stevewen\parkmmo\pkdedfee.doc • RESOLUTION 95 -87 RESOLUTION AMENDING THE PARK DEDICATION FEE FOR RESIDENTIAL AND COMMERCIAL DEVELOPMENT WHEREAS, the City Council of the City of Elk River, in Ordinance 87-1, established that a development fee may be paid for Park Dedication purposes and that this fee shall be set by resolution of the City Council; and, WHEREAS, the City Council has received and reviewed a recommendation from the Elk River Park and Recreation Commission that the Park Dedication Fees be increased, due to the increased need for recreational opportunities which increased development causes; increasing land values in the City of Elk River; and the increasing costs of providing recreational opportunities in the City of Elk River; and, WHEREAS, the adoption of this resolution adjusts the Park Dedication Fees adopted in Resolution 92-122. • NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River that Park Dedication Fees paid to the City in lieu of 10% of the undeveloped land shall be set at: Residential: $550/lot or dwelling unit effective 1/1/96 $600/lot or dwelling unit effective 1/1/97 $650/lot or dwelling unit effective 1/1/98 Commercial: $1,750 per acre effective 1/1/96 $2,000 per acre effective 1/1/97 Passed and adopted by the City Council of the City of Elk River this 18th day of December, 1995. en r A.
