Action Requested
Approve or deny, by motion, the Conditional Use Permit (CUP) as proposed. If a motion to approve is
made, staff recommends the following conditions:
1. As a CUP is not a Building Permit, the applicant shall apply for all required permits.
2. Fitness /martial arts class sizes shall not exceed 80 students.

Adam Ahern, owner of Academy Elk River, is requesting a CUP to locate a commercial recreational
facility in the I -1 (Light Industrial) district. A CUP is required because, in the past, the City Council was
concerned with the loss of industrial space.
The Academy Elk River has been open since April of 2012 and offers martial arts programs for people of
all ages and abilities. Having outgrown their current space at 18550 Dodge Street NW in the Elk Hills
Center development, near Perkins and the Country Inn, they wish to relocate to the I -1 district.
Financial Impact
None
MN Statute § 15.99 deadline
The city must take action by March 27, 2015.

Adam Ahern, owner of Academy Elk River, is requesting a CUP to locate a commercial recreational
facility in the I -1 (Light Industrial) district. CUP approval is required before the applicant is permitted to
open his business as commercial recreational facilities are listed as a conditional use in the I -1 zoning
district. A CUP is required because in the past, the City Council was concerned with the loss of industrial
space.
The Academy Elk River has been open since April of 2012 and offers martial arts programs for people of
all ages and abilities. Having outgrown their current space at 18550 Dodge Street NW in the Elk Hills
Center development, near Perkins and the Country Inn, they wish to relocate to a warehouse in the I -1
district.
The proposed location is a 5,000 SF facility at 12671 Meadowvale Rd NW. The interior space will remain
largely un- improved and will primarily be open space with exercise mats and a full-size ring. If the CUP is
approved, the applicant will add one additional bathroom and a locker room. The Academy has one full-
time employee and one part -time employee and hours of operation are: 5:00am — 6:00am, 11:00am —
2:00pm, and 5:00pm — 9:00pm.

The applicant states that approximately 20 parking spaces are needed at peak hours. Additionally, city
ordinance requires one parking space for every four patrons at capacity for general recreation uses. If
class sizes exceed 80 students, additional parking will be required. The required 20 parking spaces are
provided by existing spaces around the leased portion of the building.

Site Improvements
The applicant is not proposing any changes to the building exterior or surrounding site.

Signage will be provided by the existing monument sign along Meadowvale Road and the only signage on
the building will be window signs identifying the location and entrance. Neither sign will need a building
permit.
Comprehensive- plan
The I -1 (Light Industrial) zoning classification reflects the comprehensive plan's land use designation of
Industrial. Commercial recreational uses are conditional in the I -1 zoning district.
Applicable Regulations
Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
(1) Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate
viciniy or the public health, safey, morals, comfort, convenience orgeneral welfare of the neighborhood or the ciy.
(2) Will be consistent with the comprehensive plan.
(3) Will not impede the normal and orderly development and improvement of surrounding vacant propery.
(4) Will be served adequately by and will not adversely affect essential public facilities and services including
streets, police and fire protection, drainage, refuse disposal, water and sewer ystems, parks and schools; and
will not, in particular, create traffic congestion or interference with traffic c on adjacent and neighboring public
thoroughfares.
(5) Will not involve uses, activities, processes, materials, equipment and conditions oj-operation that will be
detrimental to any persons or propery because of excessive traffic, noise, smoke, fumes, glare, odors, dust or
vibrations.
(6) Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
(7) Will fully comply with all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license orpermit to establish and operate the proposed use in the city.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30 -654.

Academy Elk River Project Narrative
Academy Elk River has been open since April of 2012, offering martial arts programs for
men, women and children of all ages. In that time we have helped many students
achieve fitness goals, develop self confidence and enter the competitive arena. Having
outgrown our original space in Elk Hills Center, we wish to relocate to a spacious
warehouse in an 11 zoned area.
Hours of operation are clustered in three areas; 5:OOAM - 6:OOAM, 11:00AM - 2:OOPM,
and 5:OOPM - 9:OOPM.
We have 1 full time employee and 1 part time employee at this time.
Roughly 20 parking spaces are needed at peak hours.
Signage space is already provided in front of the building (rectangular box on a pillar
provided by the owner).
We will have no outdoor storage.
Light buildout will be required to add a restroom and a locker room.
We intend to continue our practice of improving our students lives through fitness and
responsible martial arts training.
