Please consider a request by Valvoline Instant Oil Change for a Conditional
Use Permit to construct an Oil Change shop in the Hillside Crossing Planned

Overview
The applicant wishes to construct a Valvoline Instant 0il Change shop on a
.93-acre site located on Evans Avenue across from Northbound Liquors and

adjacent to the Coborn's parking lot. The site is one of two remaining
undeveloped sites in the Planned Unit Development.
The Hillside Crossing PUD Agreement identifies both motor vehicle service
stations and motor vehicle specialty shops as conditional uses. Valvoline
Instant Oil Change is a motor vehicle specialty shop and if in the future the
use changes to a service station, then a new conditional use permit will be
needed.
The services performed at the Valvoline shop include auto tire rotation and
fluid replacement. Valvoline Instant Oil Change shops average 48 cars per
day at their 6 stores. The proposed hours of operation are 8 AM to 8 PM,
Monday through Friday, 8 AM to 5 PM on Saturdays and 11 AM to 5 PM on
Sundays.
Site Plan
The proposed plans submitted by the applicant conform to the Hillside
Crossing Development Plan in regards to parking, signage, grading, drainage
and landscaping.
Landscaping
The landscaping proposed by the developer conforms to the Hillside Crossing
PUD. To minimize glare from cars exiting from the shop, staff has requested
that the Mugho Pines be maintained at a height of 4-6 feet.
Signs
The PUD Sign Agreement allows freestanding sites to have one monument
sign with a maximum height of 10 feet and a maximum of 100 square feet of
area. Freestanding buildings are allowed one wall sign with individual
letters that cannot exceed 10 % of the building wall. The applicant is
proposing a 100 square foot monument sign and a 37.6 square foot wall sign
that conform to the Sign Agreement.
The applicant will be required to apply for a Sign Permit prior to installing
signs on the property.
Grading and Drainage
The City Engineer has reviewed the proposed development and has found
that what is proposed conforms to the overall Hillside Crossing Grading
Plans.

Trash and Oil Storage
As proposed a rock faced concrete dumpster enclosure with a wood gate will
be constructed to match the materials and color of the building. The
dumpster gate will face the Coburn's parking building and will not face the
public right-of-way.
New and used oil will be stored in the building in a separate room as
required by the building code.
Lighting
The applicant is proposing to light the site with (4) 19 foot pole hghts with
white metal halide fLxtures that conform to the lighting standard set by the
Coborn's development.
Parking
The applicant has proposed 8 parking stalls, one handicap accessible and
conforms to the parking requirements. The will be no on-site storage of
vehicles as the business is a drive through service.
Pedestrian Access
A sidewalk is being provided connecting the building to the public sidewalk
on Evans.
Building Elevation
The Planning Commission requested that the building be constructed with an
earth tone rather than gray as had been proposed. The applicant has
provided staff a buff/tan block sample called, "Sahara."
Planning Commission
At the public hearing held on December 28,1999, the several residents
insisted that a fence was promised them at the rear of Lot 2, Block 2 when
additional development occurs. Staff research found that The Hillside
Crossing Development Standards stipulate that a berm will be constructed
behind the building on the portion of the site that abuts residential
properties with an 8 foot privacy fence to provide noise attenuation and to
provide screening. The Hillside Crossing Landscape Plans show a fence
behind the Coborn's building, but the fence ends at the edge of the Coburn's
property and does not extend further to the south.

City staff recommends that any additional fencing should be considered at
the time the last remaining undeveloped Hillside Crossing parcel, Lot 2,
Block 2, is developed.
Additional concerns included, having the building colors be earth tone rather
than gray, and concerns about noise and brightness of lights.
Recommendation
Staff and the Planning Commission recommend that the City Council
approve of the Conditional Use Permit to construct a Valvoline Instant Oil
Change with the following conditions:
THAT THE MUGHO PINES BE MAINTAINED AT A HEIGHT OF 4-6 FEET
TO SCREEN HEADLIGHT GLARE FROM EVANS STREET.
THAT THE PARKING STALLS, HANDICAP STALLS AND STACKING
LANES BE STRIPED AS REQUIRED BY CITY ORDINANCE.
3. THAT THE SITE BE ILLUMINATED AS REQUIRED BY CITY ORDINANCE.
THAT ANY SIGNS CONFORM TO THE HILLSIDE CROSSING PUD
AGREEMENT AND ATHAT A SIGN PERMIT BE OBTAINED PRIOR TO
INSTALLATION OF ANY SIGNS.
THAT ALL COMMENTS OF THE CITY ENGINEER BE ADRESSED.
THAT A CONDITIONAL USE PERMIT BE APPLIED FOR IF THE USE OF
THE PROPERTY CHANGES FROM THE INSTANT OIL CHANGE TO A FULL
SERVICE AUTOMOTIVE REPAIR OPERATION.
THAT THE BUILDING BE CONSTRUCTED WITH BROWN TONE BLOCK
COMPATABLE WITH THE NORTHBOUND LIQUOR.

Main level floor area - 1,710 square feet. Lower level floor area -
1,484 square feet. Building area lot coverage is four (4) percent of the
total lot area of, 40,476 sf. (.93 acres). Site hard surface (concrete and
bituminous) area is forty-seven (47) percent or 18,984 sf. Landscape
area is forty-nine (49) percent or 19,788 sf.
The proposed landscape plan incorporates the general guidelines
recommended by the City of Elk River and the original development
agreement. The dumpster enclosure has been screened with Black Hills
Spruce. Additional screening and buffering of the cars exiting the building
has been included with Mugho Pines. Trees have been included to
provide an accent at the open sod area both north and south of the entry
drive and parking area. The landscape and sod areas will include
underground irrigation. The tree count of overstory (8), understory (2) and
evergreens (10) is equal to the original development agreement.
Signage:
Site and building signage has been noted on the elevations along with
sign examples. The building signage will be on one side of the building
(West). The site sign or monument sign will be located at the Northwest
corner of the site. The proposed signage is within the City sign
requirements,

SITE PLAN REVIEW
Dear Mr. Wensman:
As requested we have reviewed the Valvoline Instant Oil Change submittal package. The
package consisted of a site plan, landscaping plan, grading and utility plan, Alta survey and
building details. The submittal was prepared by K.K. Design and was dated November 29,
1999. Based on our review we would offer.the following comments.
1. The site plan should include a sidewalk extending from the building to the existing sidewalk
along Evans Street.
2. There are some landscaping elements in the northeast corner of the site, which fall in a
drainage and utility easement. These landscaping elements should be removed from the
utility easement area.
3. The driveway entrance into the building site is located approximately 125-feet from Evans
Street. This is a reasonable distance for this driveway to be located away from Evans
Street. This driveway location will dictate where the driveway is located on the undeveloped
lot located to the east.
4. From the proposed building site drainage would flow to the east to the service drive. There
are no additional catchbasins shown to pick up to drainage generated from the Valvoline Oil
site. There is an existing 30-inch storm sewer pipe which crosses their driveway near the
connection to the service road. We would suggest that additional catchbasins be added to
this 30-inch storm sewer line in an effort to pick up all drainage prior to flowing onto the
service road and potentially onto Evans Street.
5. The grading plan does show the perimeter of the site being provided with silt fence with the
exception of the driveway access points. The driveway access points will be provided with a
rock construction entrance approximately 6-inches deep, 50-feet long with a width that
varies. This approach should provide adequate erosion protection during the construction.

DEVELOPMENT STANDARDS
Architectural
The proposed design and color scheme of the buildings within this plat will be
consistent with the aesthetics of the area.
The grocery store will be constructed in Phase I, and will consist of decorative
painted concrete block, brick, stucco and glazing on the west and south sides of
the structure. The north and east sides will maintain the decorative painted
concrete block, brick and stucco theme. The exterior colors will be of the
"earth" tones with a border stripe around the top of the building.
The glazing area will highlight the entrance to the Q-Cumbers restaurant on the
southwest corner of the grocery store, and will include an attractive canopied
atrium entrance of a design and color that will instill a distinctive look to the
facility and will be consistent with the theme for the grocery store and the
entire plat.
Liqhtinq
Ail lighting will be in conformance to city standards; general site lighting from
high pressure sodium lamps on a painted steel pole fixture at heights of 35 feet.
The parking lot will provide an average of 2.5 foot candle coverage on the
surface. Special attention will be placed on the back of the building where all
lights will be designed and installed so as to shield any light away from the
residential area.
Other areas, including major entrances, roadways and pedestrian walkways, will
be illuminated with a "white" metal halide light on a decorative light fixture
to maintain and enhance the quality of this retail development and its
compatibility with the equally high standards of the surrounding neighborhood.
The fixtures in this phase of development will establish the standard for
subsequent development phases of this plat.
Landscaping
The landscaping, an integral part of this development, is designed and will be
installed in a first class and aesthetically pleasing theme. We will establish
a visually and environmentally satisfying landscape which will be fully
compatible with the characteristics of the site and its tenants. An appropriate
mix of seasonal and ornamental shrubs, overstory trees and evergreens will
provide a visual display of taste and balance.
Special detail and attention will be placed on the portion of the site which
abuts the residential sections. A berm will be constructed behind the building
along the plat property line. On top of this will be an 8 foot high privacy fence
of material which will be visually pleasing as well as to provide noise
attenuation. Adequate and appropriate shrubs, trees and plantings will accompany
this area to provide additional protection and a visually attractive environment.
Another area which will receive high priority in the initial development phase
is the retention pond located in the southeast corner of the plat. This existing
pond will be completed to accept the storm water from the developed site and will
be constructed to accommodate the 100-year rain level. It will be retained with
a level of rock rip-rap and two additional levels of Keystone blocks; topped off
with sod, clustered shrubs and ornamental trees. Additionally, a 4 foot fence
will be installed at the top of the pond for security.
