The purpose of this Ordinance which is enacted pursuant to Minnesota Statutes, is to secure the quiet, orderly and suitable use of public parks, trail systems, and public access to lakes established by the City of Big Lake, and to further the safety, health, comfort and welfare of all persons in the use thereof. SECTION 3700.020 Definitions. For the purpose of this Ordinance, the terms defined in this Section shall have the meanings given them in this Section. 1. "Big Lake Parks" means the park organization or system in the City of Big Lake. 2. "Park Director" means the person appointed by the City Administrator to serve as the chief administrative officer of the City Park System. 3. "Park" means any land or water area and all facilities • thereon, established as a part of City of Big Lake pursuant to Minnesota Statutes. 4. "Park Visitor" means any person, firm, partnership, association, corporation, governmental unit, company or organization of any kind within a park. 5. "Vehicle" means any motorized, propelled, animal drawn or human powered conveyance. 6. "Domestic animal" means a dog, cat or horse. 7. "Motorized Recreation Vehicle" means any self propelled, off-the-road, or all terrain conveyance, including but not limited to a snowmoble, minibike, amphibous vehicle, motorcycle, go-cart, trail bike, dune buggy, or four-wheel drive. 8. "Weapon" means any devise from which shots or projectile of any type can be discharged by means of explosive, gas, compressed air or otherwise propelled, including but not limited to firearms, bow and arrows, slings and spring guns. 9. "WildLife" means all living creatures, not human, wild by nature, endowed by sensation and power or voluntary motion, including quadrupeds, mammals, birds, fish, amphibians, reptiles, crustaceans and mollusks. 10. "Intoxicating Liquor" means any liquor which is intoxicating pursuant to Minnesota law and includes ethyl alcohol, distilled, fermented, spirituous, vinous, and malt beverages containing in excess of 3.2 percent alcohol by weight. 11 . "Non-Intoxicating Malt Liquor" means a beverage containing not more than 3.2 percent alcohol by weight. 12. "Drugs" means any substance defined as a controlled substance by Chapter 152, Minnesota or other statutes of Federal Law or regulation. t • ORDINANCE 3700 page 2 4!/ SECTION 3700.030 General Conduct. It shall be unlawful for any person to: 1. Use threatening, abusive, insulting, obscene or indecent language or to act in an indecent manner, or to do any act which constitutes a breach of the public peace in a park. 2. Have in possession or bring into a park "Non-Intoxicating" or "Intoxicating" Malt Liquor or beer in kegs or barrels. 3. Consume any alcoholic beverage, whether "Intoxicating Liquor" or "Non-Intoxicating Liquor" in a park after 10:00 p.m. o'clock p.m. and before the park is open the following day. • 4. Disturb, harass or interfere with any park visitor's property. 5. Deposit, scatter, drop or abandon in a park any bottles, cans, broken glass, sewage, waste or other material, except in receptacles provided for such purposes. 6. Enter a park with glass beverage containers. 7. Dig trenchs or make other excavation in park. 8. Throw, discharge or place on or upon any lake, stream, creek, pond or other body of water in or adjacent to a park, or tributary, stream, storm sewer, or drain flowing into such waters any substance, liquid or gas. 9. Gamble or participate in any game of chance in a park. 10. Use any land or body of water within a park for starting landing field for aircraft, balloons, or parachutes, without a permit from the Park Director. 11. Start a fire in the park, except a small fire for culinary purposes in a designated area, or fail to fully extinguish such a fire. 12. Drop, throw or otherwise leave unattended in a park, lighted matches, burning cigars, cigarettes, tobacco, paper or other combustible material. 13. Sell, solicit, or carry on any business or commerical enterprise or serve in a park unless authorized by the Park Director in writing. 14. Use loudspeakers or other amplifying systems in a park, except with written permission from the Park Director. SECTION 3700.040 Protection of Natural Resources and Wildlife. It shall be unlawful for any person to: 1 . Injure, destroy, or remove any tree, flower, shrub, plant, rock, soil, and mineral in a park. 2. Kill, trap, hunt , pursue or in any manner disturb or cause to be disturbed any species of wildlife within a park except that fishing may be permitted in designated areas. 3. Shoot any weapon into a park from beyond park boundries. 4. Bring a dog, cat , horse or other domestic animal into a park unless under the control of the owner or attendant and such custodian shall have the responsibility of cleaning up any feces of any animal and shall dispose of such in a sanitary manner. J Ordinance 3700 • page 3 5. Bring or permit any dog, cat, horse or other domestic animal to enter a beach area, nature center area, picnic area, park building or skating rink. 6. Permit a dog, cat, horse or other domestic animal to disturb, harass or interfere with any park visitor or visitor's property. 7. Possess any weapon (as identified in Section 3700.020) -'. within a park. 8. Release within a park any plant, chemical or other agency potentially harmful to the vegetation or wildlife or the park. 9. Remove any animal, living or dead, from a park and any animal so removed or taken' contrary to the provisions of this Ordinance or laws of the State of Minnesota shall be considered contraband and subject to seizure and confiscation. SECTION 3700.050 Camping. It shall be unlawful for any person to: 1. Camp in a park. SECTION 3700.060 Swimming. It shall be unlawful for any person to: • 1 . Wade or swim within a park except at beaches designated for that purpose, and then only between sunrise and sunset, or such hours as may be designated by the Park Director, any park visitors shall swim or wade at their own risk. 2. Take bottles or glass of any kind, except eyeglasses into a designated beach area. 3. Use air mattresses, innertubes or other inflatable devices except in designated beach areas. SECTION 3700.070 Boating. It shall be unlawful for any person to: 1 . Launch or land any boat, yacht, canoe, raft or other watercraft upon any water, lagoon lake, pond or slough within a park except at locations and times designated for that purpose. 2. Leave unattended any boat or watercraft except in areas designated for that ur ose. P P 3. Operate any watercraft in a designated swimming area or other prohibited area. 4. Operate any watercraft in a park in violation of Minnesota Statutes, Chapter 361 , "Waters and Watercraft Safety." SECTION 3700.080 Fishing. It shall be unlawful for any person to: 1 . Leave any structure or shelter in any park for more than forty—eight (48) hours. Ordinance 3700 page 4 SECTION 3700.090 Horseback Riding. It shall be unlawful for any person to: 1 . Ride a horse or bring an untrailered horse into a park. SECTION 3700.100 Bicycling. It shall be unlawful for any person to: 1. Operate a bicycle except at park designated bikeways and roadways, and kept as close to the right hand side thereof as conditions will permit. SECTION 3700.110 Meetings, Speeches, Demonstrations and Parades: It shall be unlawful for any person to: 1 . Conduct public meeting, assemblies, entertainment, • parades or demonstrations within a park without first obtaining a written permit from the Park Director, and then only in an area designated by a permit. SECTION 3700.120 Vehicles. It shall be unlawful for any person to: 1. Operate any vehicle within a park except upon designated roadways and parking areas. 2. Operate a vehicle in a park at a speed in excess of posted speed limits. 3. Park or leave a vehicle standing within a park except at a designated parking area. 4. Operate a vehicle which emits excessive or unusual noise, noxious fumes, dense smoke or other polluting matter. 5. Operate a vehicle in a reckless or careless manner in a park. 6. Wash, polish, grease, change oil or repair any vehicle in a park. SECTION 3700.130 Motorized Recreation Vehicle. It shall be unlawful for any person to: 1 . Operate a motorized recreation vehicle within a park except on designated roadways and parking areas. 2. Operate a snowmobile within a park other than on designated trails within the park for snowmobile traffic. SECTION 3700.140 Park Operation. • 1 . A person may be granted a permit for temporary exclusive use of reserved space within a park. 2. No person shall remain within a park between the hours of 10:00 p.m. and 5:00 a.m. 3. Any permit granted pursuant to this Ordinance, may be revoked upon the violation by the permitee of any Ordinance, rule or regulation of Parks, City of Big Lake. Ordinance 3700 , page 5 4. It shall be unlawful for any person to use any facility or area for which a fee or charge has been established by the City of Big Lake without payment of such fee or charge. 5. The City of Big Lake shall not be liable for any loss, damage or injury sustained by a park visitor. 6. Any park portion thereof may be declared closed to the - public by the City Council of the City of Big Lake or the Park Director at any time and for any interval of time or to certain uses, as the City Council or Park Director shall find reasonable necessary. SECTION 3700.150 Enforcement and Penalties. 1. A person guilty of violating any provision of this Ordinance shall be guilty of a misdemeanor which is punishable by a fine of not more than three—hundred ($300.00) dollars, or by imprisonment for a period not to exceed ninety (90) days, or both. 2. Designated Big Lake Parks employees may, in connection with their duties imposed by law, diligently enforce the provisions of this Ordinance; and eject from parks, persons action violation of this Ordinance. 3. The Park Director shall have the authority to revoke for good cause any permit or reservation issued by the Park Director. 4. The City Council or Park Director, of the City of Big Lake, shall have the right to issue administrative rules and ( regulations that may be established by the Council or Park Director. 5. Nothing in the Ordinance shall prevent employees or agents of the Big Lake Parks from performing their assigned duties. 6. No person shall impersonate any employee of the Big Lake Parks, nor interfere with, harass or hinder any employee in the discharge of his duties. 7. If any provision of this Ordinance is held to be invalid, such invalidity shall not effect the validity of any other provision of this Ordinance. SECTION 3700.160 Waiver. Any provision of this Ordinance may be waived at the • discretion and direction of the City Manager. SECTION 3700.170 This Ordinance shall be effective from and after its date of passage and publication according to law. Curtis W. Snesrud Administrator (August 23, 1979) CITY OF BIG LAKE ORDINANCE NO. 301 An Ordinance Regulating the Speed and Direction of Boats on Lake Mitchell and Big Lake The City Council of Big Lake does hereby ordain: Section 301 .01 : This Ordinance shall apply to the bodies of water in the City of Big Lake known as Big Lake and Lake Mitchell. Section 301 .02: All boats exceeding a slow-no wake speed shall travel in a counter-clockwise direction. . Section 301 .03: Maximum speed limit of boats shall be 40 m.p.h. at all times with the exception of those areas and times listed in Section 301 .04 and 301 .05. Section 301 .04: Maximum speed limit of boats shall be 15 m.p.h. sunset to sunrise all year. Section 301 .05: A slow-no wake speed shall be maintained in the area extending 100 feet from the shore. Boats launching or landing water skiers by the most direct route to open water shall be exempt from this provision. Section 301 .06: Any boat owner or the operator thereof if the owner not be present who violates any provision of this ordinance shall be guilty of a misdemeanor. Section 301 .07: Definition. Slow no wake means operation of a watercraft at the slowest possible speed necessary to maintain steerage and in no case greater than 5 m.p.h. Section 301 .08: Primary enforcement of this ordinance shall rest with Sherburne County Sheriff 's Office. Section 301 .09: The City of Big Lake shall be responsible for marking the public accesses and lakes with signs or bouys explaining the rules and regulations of this ordinance. Administrator CITY OF BIC LAKE ORDINANCE NO. 2 An Ordinance Permitting the Placement of Temporary Docks Adjacent to the Shore of Big Lake on Certain Designated Public Rights-of-Way 1. The temporary placement of docks shall be permitted from specified areas of public property and/or public rights-of-way adjacent to the shores of Big Lake and Mitchell Lake in the following described area: All that part of Shadywood Park according to the recorded plat " . thereof, Sherburne County, Minnesota lying Easterly of a line distant 66.00 feet East of the Easterly lines of Blocks 1, 2, 3, 4 and 5 and there Northerly and Southerly extensions and All that part of Oakland Heights according to the recorded plat thereof, Sherburne County, lying g Easterly of a line distant 66.00 feet East of the Easterly lines of Blocks 1,2 and 3, and there Northerly and Southerly extensions. 2. All docks shall be marked with the owner's name and address in a conspicuous place clearly visible to the public. 3. All docks, boat lifts and all other personal property must be removed from Big Lake and Mitchell Lake and the public right-of-way as hereinabove described between November 15 and April 1 of each calendar year. 4. A violation of a provision of this Ordinance is a misdemeanor. 5. Notwithstanding any other penalties described herein, in the event a party fails and/or refuses to remove' a dock or other personal property from the lake or public right-of-way, then upon failure to comply following written notice tb the owner as identified in accordance with Paragraph 2, the City of Big Lake shall be entitled to remove said offending property, storing and selling the same in accordance with offending property, storing and selling the same in accordance with Minnesota Statutes. In the event the City of Big Lake suffers a cost of storage and/or sale which is not recovered from the sale, the City of Big Lake shall be entitled to maintain a cause of action against the owner of the dock and/or property to recover the remaining balance. 6. Inspections. The licensee shall allow any peace officer, health officer, or properly designated officer or employee of the City to enter, inspect, and search the premises of the licensee during business hours without a warrant. 4 . Display During Prohibited Hours. No on-sale establishment shall display liquor to the public during hours when the sale of liquor is prohibited. 5. Federal Stamps. No licensee shall possess a federal whole- sale liquor dealer 's special tax stamp or federal gambling stamp. 802.16 - Restrictions on Purchase and Consumption. 1. Liquor in Unlicensed Places. No person shall mix or prepare liquor for consumption in any public place or place of business unless it has a license to sell liquor on-sale or a permit from the Commissioner of Public Safety under Minnesota Statutes, Section 340.119, and no person shall consume liquor in any such place. 2. Consumption in Public Places. No person shall consume liquor on a public highway or in a public park or other public place. 802.18 - Suspension and Revocation. The Council may suspend for not to exceed sixty (60) days or revoke any liquor license upon a finding that the licensee has failed to comply with any applicable statute, regulation or ordinance relating to intoxicating liquor. No suspension or revocation shall take effect until the licensee has been afforded an opportunity for a hearing pursuant to Minnesota Statutes, Sections 15.0418 to 15.0426. Section 804 - Establishin. and Re.ulatin. the O•eration of a Munici•al Liquor Dispensary 804 . 00 - Definitions. Unless the context clearly indicates other- wise, the words, combinations of words, terms or phrases as used in Section 804.00 et seq. shall have the meanings set forth in the following paragraphs: 1. "Intoxicating liquor" and "liquor" shall mean ethyl alcohol , distilled, fermented, spiritous, vinous and malt beverages containing more than three and two-tenths percent ( 3 . 2%) alcohol by weight. 2. "Beer" shall mean any malt beverage with an alcoholic content of more than one-half of one percent (1/2 of 1%) by volume and not more than three and two-tenths percent ( 3. 2%) by weight. Pursuant to due call and notice thereof, the meeting of the Elk River 1 • Park and Recreation Commission was called to order at 7:15 p.m. by Vice Chair Anderson. 2. Consider 6/7/89 Park and Recreation Commission Agenda It was the consensus of the Park and Recreation Commission that the agenda was acceptable as presented. 3. Consider 5/3/89 Recreation Board Minutes ( It was the consensus of the Park and Recreation Commission that with the addition of Marilyn VanPatten to the list of members present, the minutes were acceptable. 4. Public Mike 4.1 Orono Lake Homeowners Association The Orono Lake Homeowners Association were represented by Sheridyn McClain, Cindy Plant and Bonnie Rule. The Association presented a proposed ordinance for regulating boat traffic on Lake Orono. This ordinance was in the form of a survey taken by the Association. A • copy is attached. The Park and Recreation Commission discussed this survey and agreed with the homeowners that regulation of boat traffic is needed. One item of disagreement was that the Commission did not think it was possible to limit the number of boats on the lake or limit the number of trailer parking spaces. The result of the discussion is that the Commission would like City Staff to start the process for developing an ordinance similar to the one presented, excluding the boat and parking limits. This ordinance should of course comply with existing State and Local laws and be developed according to City rules governing such ordinances IIIincluding any public hearings if necessary. The hope would be to have this ordinance, along with proper signage, in effect by the 1990 boating season. Tom Tyler also addressed this issue relating some of Big Lake's experiences. He said that Big Lake's ordinance has brought in more frequent Sherburne County Water Patrol because they now have strict rules to enforce when patroling.
