Attached is my letter dated 12-20-06 to the DNR addressing this issue. The legal departments of the League of Minnesota City, (LMC) and Peter Beck, Elk River City Attorney are also looking at this issue and our ordinance. I will update you further at our commission meeting with LMC and Peter Beck's responses. Also attached is the DNR's response to my letter. Both the city council and Elk River Municipal Utilities Commission has adopted section 102 Water Service Connection of the "Water Rules" as attached to this letter. My question to you is as follows: 1) Does section 102 "Water Service Connection"have adequate language to prevent water customers from installing new wells for irrigation purposes when the municipal water system is available? If not, what changes should be made? 2) How do we enforce section 102 if irrigation wells are installed outside of possible enforcement by DNR or MNDH? 3) Are there other avenues available to us to prevent this activity? Would it be possible to receive a response by January 8, 2007 before our next Elk River Municipal Utilities Commission meeting? If you need additional information, do not hesitate to call. General Manager i Elk River ^� Municipal Utilities 13069 Orono Parkway phone: 763.441.2020 Elk River, MN 55330 Fax 763.441.8099 December 20, 2006 Ms. Laurel Reeves DNR Water 500 Lafayette Rd Box 48 St. Paul, MN 55155-4048 Subject: Water Use Permit Dear Laurel, Elk River School District#728 has a desire to bypass the Elk River municipal water system and utilize their own wells for lawn irrigation purposes. Eastern Elk River is in the beginnings of an approximate 1000 home development. See the attached conceptional composed map. The area contains a school named Twin Lakes Elementary that is currently under construction. Adjacent to this school is an area set aside for future well, treatment plant, police and fire station. There is a farm irrigation well on the grade school property(remnants from the previous farm) the school district desires to use for irrigating their lawn and ball fields. This is a Mt Simon Hinkley Well. The well log is attached. The MN unique well number is 664852 and is built to non municipal standards. This existing well is approximately 100 yards from the future municipal well and will be within the DWSMA of the future municipal well. The school district is also in the process of constructing a new well at Lincoln Elementary School at 600 School St., Elk River. The intent is to by pass the municipal water system and use the well for irrigating the school lawns and play area. It is not known if this well under construction will end in the Mt Simon Hinkley formation. This well is at the edge of the DWSMA for our municipal well #3 and may have a detrimental effect on our plans to utilize our municipal well #2 as an aquifer storage and recovery well. The utilization of the existing irrigation well at Twin Lakes Elementary and the well under construction at Lincoln School by the school district will have a negative impact on the municipal water system of Elk River. MN Statute 103I.111 Subd 3 states ".... A political subdivision may not regulate the construction, repair, or sealing of wells...."In other words, local ordinance can not prohibit the construction of water wells; this is reserved to the MN Dept of Health. MN Statute 103G.271 addresses appropriations and use of waters. Subd 2 states ".... A water use permit may not be issued under this section unless it is consistent with state, regional, and local water and related land resources management plans if the regional and local plans are consistent with statewide plans." The Elk River Municipal Utilities requests that water use appropriation permit for these two wells not be issued to Elk River School District #728 for the following reasons: 1) Elk River City ordnance and Elk River Municipal Utilities policies requires all building to connect to the municipal water system if available. See attached ordinance. The water system is available at both locations. This ordinance exists because the revenue from water sales pays for the infrastructure costs to furnish domestic water, fire protection, and water for irrigation. Allowing water customers to construct new wells for the irrigation use will substantially change the water revenue stream, there-by jeopardizing the ability to pay outstanding water revenue bonds. Other customers in Elk River have inquired about constructing irrigation wells. Allowing this is not. consistent to local financial planning. 2) The Elk River Municipal Utilities has adopted, and the DNR has approved, our Well Head Protection Plan. The existing Twin Lakes Elementary School irrigation well, built to non municipal standards is in the DWSMA of the future municipal well. The well under construction at Lincoln School is adjacent to well # 3 DWSMA and is in the 10 to 20 year travel area. This well could also compromise the aquifer storage and recovery project for municipal well #2. This is not consistent with the Well Head Protection Plan. 3) The Elk River Municipal Utilities has adopted, and the DNR has approved, our Conservation and Emergency Plan. Part III of this plan addresses water conservation measures. In the past, the school district has not followed the sprinkling restrictions outlined in this plan. A conservation strategy as suggested by the DNR is inclining block rates. The Elk River Municipal Utilities has implemented this rate strategy. The school district responded it is more economical to construct an irrigation well than pay the Elk River Municipal Utilities rate structure. These rate sheets are enclosed. By allowing the school district to utilize these irrigation wells, you are allowing them to circumvent the conservation strategies of our water plan. This is not consistent with the water plan. 4) Ground water, particularly from the Mt Simon Hinkley aquifer, is a valuable natural resource. It is the only viable aquifer in the Elk River area. The public perception that ground water is "free" and "inexhaustible"can not be promoted, and must be highly discouraged. The current public policy of renewable and sustainable use of natural resources does not support the utilization of these two irrigation wells. We ask for your support in this matter. OF HEALTH COPY 545412054Y ••v.WI, IC%140-0020 WATER RULES 102 WATER SERVICE CONNECTIONS CONNECTION TO MUNICIPAL WATER SYSTEM The following buildings shall be required to be connected to the city water system at current fees and rates: (Unless City Council by resolution establishes other time parameters for specific developments) 1) All buildings connected to the water system on the date of adoption of these rules shall remain connected to the water system for so long as the building is occupied or used for any purpose. 2) All buildings constructed in the future on property which water utility service is available at the time a Certificate of Occupancy is issued for the building shall be required to connect to the water system prior to occupancy. 3) All buildings constructed in the future on property to which water utility service becomes available following legal occupancy of the building shall be required to connect to the water utility as follows: a) All residential buildings with one or two residential units shall be required to connect to the water utility within two (2) years from the date water utility service becomes available to the property or the date the property is assessed for water utility improvements, whichever is later. b) All other buildings shall be required to connect to the water utility within ninety (90) days from the date water utility service becomes available to the property. 4) All buildings existing on the date of adoption of these rules on property to which water utility service becomes available in the future shall be required to be connected to the water utility as follows: a) All residential buildings with one or two residential units shall be required to connect to the water utility within two (2) years from the date the water utility service becomes available to the property or the date the property is assessed for water utility improvements, whichever is later. b) All other buildings shall be required to connect to the water utility within ninety (90) days from the date water utility service becomes available to the property. 5) All buildings existing on the date of adoption of these rules on property to which water utility service is available but which has not been assessed for water utility improvements shall be required to connect to water utility as follows: a) All residential buildings with one or two residential units shall be required to connect to the water utility within two (2) years from the date the water utility service becomes available to the property or the property is assessed for water utility improvements, whichever is later. b) All other buildings shall be required to connect to the water utility within ninety (90) days from the date water utility service becomes available to the property. . 6) All buildings existing on the date of adoption of these rules on property to which water utility service is available and which has been assessed for water utility improvements, but which are not connected to the water utility, shall be required to connect to the water utility as follows: a) All residential buildings with one or two residential units shall not be required to connect to the water utility unless or until the Elk River Municipal Utilities determines on a case by case basis that connection to the water utility is necessary to protect the public health, safety and welfare or to otherwise comply with applicable law; b) All other buildings shall be required to connect to the city water utility within two years of the date of adoption of these rules. 5 CONNECTION TO MUNICIPAL WATER SYSTEM continued 7) All buildings not connected to the city water system, and where the city water system is available, that request waste water service shall also connect to the city water system. 8) All buildings not connected to the city water system, and where the city water is available, where their well is in need or replacement or extensive repair, shall connect to the city water system. OWNER OR CITY TO MAKE REQUIRED CONNECTION The owner of any building required to be connected to the city water system shall cause said building to be connected to the water system at the owner's expense as required. If required connections to the water system are not being made pursuant to this paragraph, the Elk River Municipal Utilities shall serve written notice on the affected property owner stating that if connection is not made within ninety (90) days after the date of said notice, the connection will be made by the Elk River Municipal Utilities at the expense of the owner and that if unpaid, the charge for such work will be made a special assessment against the property concerned. Such assessment, including interest at the legal rate for local improvements, shall be certified to the County Auditor and collected and remitted to the City in the same manner as assessments for local improvements. The rights of the Elk River Municipal Utilities/City under this paragraph shall be in addition to other remedial or enforcement rights provided by the City Code of Ordinances or other applicable law.(Adopted April 10, 2001 by the Utilities'Commission) SERVICE REQUESTS Any person, firm or corporation desiring a connection with the municipal water system of the Elk River Municipal Utilities shall apply through a licensed plumber at Elk River Municipal Utilities, at 322 King Avenue. 24-hour notice prior to tap is required. The applicant shall state the location of the premises for which a water service is desired, designated by street, lot and block, name of owner, size of the tap required and the kind and size of service pipe to be used. A connection may be disallowed if all terms of abandonment of service covered by Water Rules have not been complied with. SERVICE STANDARDS The "service" shall be part of the piping extending from the main in the street, including the corporation cock, to the meter within the building. This shall be installed by a licensed plumber at the expense of the property owner and remains the property of the owner. Supply for the individuals and for individual premises shall be taken from the common or public supply in the mains only through service pipes. Each service shall include a corporation cock, supplied and installed by the Elk River Municipal Utilities or a person or company approved by Elk River Municipal Utilities, and charged to the plumber. An inverted key stop cock, rod and a stop box with a telescoping top section as approved by Elk River Municipal Utilities must be installed in utility easement, or as directed the by General Manager. Elk River Municipal Utilities personnel will inspect the tap in all cases. The excavation site must be large enough for Elk River Municipal Utilities excavation trench box to be installed in the hole for the protection of Elk River Municipal Utilities personnel as required by OSHA. Each service shall enter the building served thereby at a point readily accessible at all times, and as close as possible to the point of service from the main. A stop valve (ball type) shall be installed on each water service pipe at a point designated by the Elk River Municipal Utilities, usually adjacent to the meter and shall supply no more than one premise unless conditions make it impossible and inadvisable in the judgment of the Elk River Municipal Utilities General Manager. As you are aware, we have also received a letter from the City of Elk River expressing concern about such plans. As the District considers the use of existing wells or new wells to irrigate school grounds, please be aware of the following potential issues: 1. Any use of water exceeding 1 million gallons per year and/or 10,000 gallons per day requires a water use permit from the Department of Natural Resources (DNR). 2. Minnesota Statutes, Sectionl03G.271, Subd. 2, requires that a water use permit cannot be issued unless it is consistent with all local plans. As you are aware, the City of Elk River has advised us that City Ordinances and policy requires use of the municipal water supply system for all water use, if it is available. It is unlikely that we could approve a water use permit for the District, if the City objects. 3. The City of Elk River has adopted and the state has approved a Wellhead Protection Plan. The City advises us that the well the District is considering using for irrigation may not be consistent with that Plan. If this is true, the DNR could not issue a water use permit to the District for use of the old irrigation well and the Department of Health could not issue any permit to construct or improve such an irrigation well. 4. The City advises us that they have plans to construct a new major water supply well within a few hundred yards of the well the District is considering using for irrigation. State Law sets up priorities for water use permits, and the City's water supply well will take priority over any irrigation well used by the District. The DNR would have to require that any use of the old irrigation well be reduced to the point where it does not interfere with any public water supply system well. In light of these facts, we urge the District to work closely with the City of Elk River in deciding how to irrigate its grounds. Based on our current understanding of the situation, it is unlikely that the DNR could approve a water use permit that would meet the District's lawn irrigation needs.
