RESOLUTION NO.
A RESOLUTION APPLYING FOR STATE OF
MINNESOTA LAND USE PLANNING GRANT PROGRAM
THE CITY COUNCIL OF THE CITY OF ELK RIVER OF SHERBURNE COUNTY, MINNESOTA, ORDAINS AS
FOLLOWS:
WHEREAS, the City of Elk River, a predominantly rural community, situated just
outside the boundaries of a concentrated urban area, finds that certain parts
of its existing plans and official controls are inadequate for the regulation
and control of development within its jurisdiction; and
WHEREAS, the City of Elk River is traversed by major corridors, US Highways 10, 52
and 169. In addition, Minnesota trunk highway 101 crosses the Mississippi to
intersect Interstate Highway 94. These highways provide good access to the Twin
Cities metropolitan area and to the St. Cloud metropolitan area. This impacts the
City by causing urban residential and commercial development in the area which will
continue at an increasing rate; and
WHEREAS, consolidation of the former Township of Elk River and the former City of
Elk River into a new City of Elk River has recently taken place by order of the
Minnesota Municipal Board, dated October 31, 1977; and
• WHEREAS, this consolidation has created a dual system of regulatory controls in-
adequate to regulate the growth of the City of Elk River as newly created; and
WHEREAS, the former City of Elk River contains a central business district and
land use for residential, commercial, industrial, institutional.and public pur-
poses. The former Township of Elk River contains land use for commercial purposes,
particularly along U.S. Highways 10, 52, 101 and 169, and land use for urban,
residential and agricultural purposes; and
WHEREAS, existing zoning in the former Township immediately adjoining the former
City of Elk River must be changed to reflect possible urban densities and urban
streets and utilities; and
WHEREAS, urban development at high densities, with on-site sewage disposal systems,
which is presently permitted, presents a potential problem of ground water pollu-
tion, and hence pollution of drinking water; and
WHEREAS, the subdivision of land in areas lying outside of the boundaries of the
former City of Elk River by way of metes and bounds legal descriptions, private
streets or streets not accepted for maintenance by the City has created and con-
tinues to create growth management and record-keeping difficulties for the City of
Elk River; and

WHEREAS , urban services capable of accommodating development at an urban level
• are not scheduled to be provided within any currently identified program; and
WHEREAS , requirements imposed by the Municipal Planning Act, the designation of
the Mississippi River as being subject to wild and scenic rivers regulation and
the desire of the City of Elk River to accommodate growth in a rational and effi-
cient manner require that the City Council prepare and recommend for hearing and
adoption amendments to its comprehensive plan and ordinances , regulations, and
programs governing the land use and development within the City of Elk River; and
WHEREAS, the City Planner and the City Attorney are in the process of or will
prepare and submit said materials which will guide overall residential density,
provide for public facilities adequate to service the area, prevent or abate
environmental degradation, reduce and eliminate nuisances , appropriately address
future industrial and commercial developments , and provide for the orderly and
rational implementation of planning for growth management for the City based on
the requirements of the above-cited statutes , regulations and the general health,
safety and welfare of the community;
WHEREAS, the fiscal posture of the City is such that an adequate and comprehensive
land use management strategy cannot be forumulated and implemented without financial
assistance;
NOW, THEREFORE, IT IS HEREBY RESOLVED, by the City Council of the City of Elk River
in regular meeting assembled, that the City Council of the City of Elk River does
hereby make application requesting grant funds from the State of Minnesota for
• land use planning grant program pursuant to the attached preliminary application and
does hereby authorize the Acting City Clerk to process said application.

WHEREAS, requirements imposed by the Municipal Planning Act, the
designation of the Mississippi River as being subject to wild
and scenic rivers regulation and the desire of the City of
Elk River to accommodate growth in a rational and efficient
manner require that the City Council prepare and recommend for
hearing and adoption amendments to its comprehensive plan and
ordinances, regulations, and programs governing the land use
and development within the City of Elk River; and
WHEREAS, the fiscal posture of the City is such that an adequate and
comprehensive land use management strategy cannot be formulated
and implemented without financial assistance;
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Elk River,
that authorization for the submission of an application for a
Land Use Planning Grant as per M.S. 4.27-4.31 be given and;
BE IT FURTHER RESOLVED that the Mayor and City Administrator are hereby
authorized to execute the grant agreement on behalf of the
City Council and;
BE IT FURTHER RESOLVED that the City Council agrees to contribute the
local share of $8,333 as stated on the grant application.
