RESOLUTION VACATING A STREET EASEMENT SOUTH
OF HIGHWAY 10 AND ADJACENT TO CLEVELAND STREET
IN THE CITY OF ELK RIVER
WHEREAS, As a result of the consolidation between the Township of Elk
River and the City of Elk River, the City of Elk River is now
responsible for those easements formally owned by the Township
of Elk River; and,
WHEREAS, A street easement previously acquired by the State of Minnesota
and recently released and described by the Minnesota Commissioner
of Transportation orders numbered 62730 and 62731 has reverted
back to the Township of Elk River and, thus, the City of Elk
River; and,
WHEREAS, The City of Elk River has no present or future plans to utilize
said street easement; and,
WHEREAS, The City has been requested by Mr. George Cowles to vacate said
easement.
• NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River
that the street easement owned by the City of Elk River south of
U.S. Highway 10 and adjacent to Cleveland Street in the City of
Elk River and released and described by the Minnesota Commissioner
of Transportation orders numbered 62730 and 62731, copies of which
are on file at the Sherburne County Auditor's Office, is hereby
vacated and released to the appropriate private property owner.
Adopted this 23 day of July, 1979, by the Elk River City Council.
