McCHESNEY DEVELOPMENT
RESOLUTION ACCEPTING THE BID
WHEREAS, pursuant to Resolution No. 79-79-20 ordering the advertisement for
bid for the designated improvements for McChesney Industrial Park, for sanitary
sewer, watermain, storm sewer and streets, said bids were received on the 3rd
day of August, 1979, opened and tabulated according to law and the following
three lowest bids were received complying with the advertisement:
S & L Excavating, Inc. $58,616.06
A.N. Johnson Construction Co. $59,639.00
Walhunt Construction, Inc. $59,966.30
WHEREAS, it appears that S & L Excavating, Inc. of Clear Lake, Minnesota is
the lowest responsible bidder;
NOW, THEREFORE, BE IT RESOLVED by the Elk River City Council as follows:
1. The Mayor and the City Administrator are hereby authorized and directed
to enter into a contract with S & L Excavating, Inc. of Clear Lake,
Minnesota for the designated improvements.
• 2. The Engineer is hereby authorized and directed to return forthwith to
all bidders the deposits made with their bids, except the three lowest
responsible bidders. When a contract is duly executed, the deposits of
the two remaining unsuccessful bidders will be returned. The bid
deposit of the successful bidder will be retained until the performance
bond has been executed and approved, after which the bid deposit will
be returned.
