The signs will include a list of tenants. Both signs are internally illuminated monument style signs. A conditional use permit is required because a change in signage is considered a modification of the PUD, which requires a conditional use permit. · Current Signage North Memorial currently has two freestanding signs. Neither sign identifies tenants. There is one sign at the north entrance to the development, near the north end of the building and the applicant has space on the freestanding sign along Highway 169. There is also a small wall sign on the south end of the building and a wall sign on the east side, facing Highway 169. Freeport Avenue Sign The overall dimensions of the sign are 9'7" tall and 16'2" wide. The sign area is 15 feet wide and 5'2" high (75 sf.). The sign base will match the existing sign at the entrance to the development as will the colors of the sign face. The sign includes spaces for 8 tenants and complies with the 10 foot setback requirement. · Sign in the From of the Building The overall dimensions of this sign are 7' high and 4' wide. The sign area is 4' wide and 4'6" high (18 sf.). The base will match the existing sign at the entrance of the development as will the colors of the sign face. The sign includes spaces for 8 tenants. The sign will be located in a landscaped peninsula at the entrance to the parking lot in front of the building. The sign is situated so that it should not block visibility. Planning Commission Fteeting At the Planning Commission meeting held on April 27th, no one spoke at the public hearing. The Commission reviewed existing signage and discussed the need to identify the building's tenants. The Commission unanimously recommended approval of the amendment to the PUD agreement. Recommendation The Planning Commission and staff recommend that the City Council approve the amendment to the Elk River Plaza PUD Agreement for two additional monument signs. WITNESSETH: WHEREAS, on December 24, 1984, the parties hereto entered into Elk River Plaza Planned Unit Development Agreement, which agreement was amended by Amendment No. 1 effective December 31, 1985, and by Amendment No. 2, effective March 16, 1987, and by Amendment No. 3, effective September 21, 1987; WHERE~S, the City Council on June 21, 1999, approved the Replat of Lot 4, Block 2, of Elk River Plaza, as Elk River Plaza 4th Addition. WHEREAS, on June 21, 1999, the Elk River City Council approved an amendment to the Elk River Plaza Planned Unit Development Agreement to permit the development of Elk River Plaza 4th Addition by the placement of the following improvements on the property: A 15,000 square foot retail building on Lot 1, Block 1, Elk River Plaza 4th Addition; the placement of a 200 seat Class I restaurant with on sale liquor, a 6,500 square foot retail building on Lot 2, Block 1, Elk River Plaza 4th Addition, and the placement of a 40,00 square foot medical office on Lot 3, Block 1, Elk River Plaza 4th Addition. WHEREAS, on November 20, 2000 the Elk River City Council approved an amendment to the Elk River Plaza Planned Unit Development Agreement to permit a second wall sign on the rear of the mall for a 6,500 square foot retail building on Lot 2. WHEREAS, on May 5, 2002, the Elk River City Council approved an amendment to the Elk River Plaza Planned Unit Development Agreement to allow the following signage: The clinic on Lot 3, Block 1 shall have 4 wall signs. The sign facing Highway 169 is 2'6" tall by 20' long (50 sf.). It is an internally illuminated box sign that reads "North Memorial Health Plaza Urgent Care" The sign facing Freeport Avenue will not be illuminated, consist of individual letters 24" tall and 36' long (72 sf.) and reads "Elk River Physicians". The sign on the south side will also be internally illuminated letters 19.5" high and 15'9" long (19.5 sf.) and reads "Now Care, Urgent Care". The total wall signage is 140.75 square feet. WHEREAS, on December 15, 2003, the Elk River City Council approved an amendment to the Elk River Plaza Planned Unit Development to permit construction of a 12,765 square foot mixed-used building. NOW, THEREFORE, it is hereby agreed by and between the parties here as follows: 1.) The Elk River Plaza Planned Unit Development Agreement is hereby amended to allow the construction of the following improvements: 1. A 75 sf. freestanding monument sign identifying tenants located on Freeport Avenue near the north entrance to the plaza. 2. An 18 sf. freestanding monument sign identifying tenants located on a landscaped peninsula at the entrance to the parking lot in front of the clinic. 2.) It is further a condition of approval of the authorized development that the same shall be completed in conformance with the attached site plan approved by the Planning Commission and City Council and that all signage and lettering shall be consistent with the approved site plan and as outlined in this amendment. 3.) The words, phrases, terms, and conditions used herein shall be interpreted the same as those used in the Elk River Plaza Planned Unit Development Agreement. 4.) All other terms and conditions of the Elk River Plaza Planned Unit Development Agreement, as amended, shall remain in full force and effect and shall be binding upon the parties hereto, except to the extent clearly inconsistent with the terms and conditions of this Amendment No. 8.
