The applicant requests that an Admimstrative Subdivision be approved to create a 2.5 acre
lot from a 1 O-acre parcel.

Analysis
The subject property is 10.7 acres in area. It is approximately 1/4 mile deep, stretching from
County Road 40 on the west to the Sherburne County line on the east. Located on the
subject property is a single-family dwelling unit and three detached accessory structures.

The applicant is proposing to create a 2.5 acre lot for the existing single family home and
two of the accessory structures. The renmant 7.5 acres will remain vacant and could be
combined with the adjacent property to the north or utilized for another buildable site.
The lots as presented meet the dimensional requirements for the Rla zoning district.
The County has indicated that a separate access will not be allowed for the second parcel;
therefore, cross access easements will be required in order for the two parcels to share one
existing driveway location.
The City Engineer has noted a number of issues including the need for spot elevations and
indication where the primary and secondary septic locations would be for the remnant
parcel.
The Park and Recreation Commission recommended cash for one lot.
Recommendation
Staff recommends that the City Council approve the admimstrative subdivision request to
create two parcels from one with the following conditions:
1. ALL REQUIREMENTS OF THE CITY ENGINEER BE ADDRESSED.
2. CROSS ACCESS EASEMENTS SHALL BE PREPARED TO ALLOW PARCEL
A TO UTILIZE THE DRIVEWAY ON PARCEL B FOR ACCESS TO
COUNTY ROAD 40.
3. PARK DEDICATION FOR ONE LOT SHALL BE PAID.
4. SURFACE WATER MANAGEMENT FEE FOR ONE LOT SHALL BE PAID.

RE: SCHMELING ADMINISTRATIVE SUBDIVISION
Dear Ms. McPherson:
As requested, we have reviewed the Schmeling administretive subdivision as prepared by
Advance Surveying and Engineering Company, and dated Apdl 20, 2004. Based on our review,
we would offer the following comments:
The administrative subdivision creates two parcels frem the apprcximately ten-acre site.
Parcel A is appreximately 7 ~ acres, and Parcel B, which contains the existing home
site, is appreximately 2 ~ acres.
The administrative subdivision should provide the right-of-way necessary for Cleveland
Street (County Road 44) in accordance with the draft right-of-way plat prepared by
Sherbume County.
Sherbume County will likely require that the two parcels share a common ddveway to
minimize access points onto the county road.
The administrative subdivision should provide drainage and utility easements according
to ordinance around the pedmetere of both sites.
There is no topography provided anywhere on the ten-acres site. Sufficient topography
should be provided on Parcel A to indicate a home site and a primary and secondary
septic site. If any wetlands are located on the site, they should be delineated and a
drainage and utility easement provided over them for protective purposes.
The description of Parcel B refere to it as the south 330 feet of the entire parcel.
Therefore, the bearing on the common lot line should be the same as the bearing on the
perimeter lot lines. This should be checked and corrected as necessary.
Both parcels meet the minimum dimensional requirements for frontage along a public
street and total lot area, given the current zoning.

It should be noted that this administrative subdivision falls in an area that is currently
under study by the City of Elk River for potential inclusion into the Urban Service Area.
Given the need for providing drainage and utility easements, it may be advisable to
prepare this administrative subdivision in the form of a simple plat for ease of recording
and describing of parcels and easements.

RE: Arnold & Linda Schmeling Property
Dear Mr. Harlicker;
We have reviewed the proposal for the Schmeling property located in the City of Elk River and adjacent
to County Highway 40 and offer the following comments. We require 50' of right of way be dedicated
to Sherbume County in fee title. County Highway 40 is designated as a collector in our transportation
system; as such private driveway access is limited to 660 feet or one per parcel. As proposed, access
must be shared at the common lot line or easements created as necessary if approved by the City. If the
access is to be relocated an access permit will be required and the developer is responsible for all
reconstruction within the right of way. If an easement is created the present driveway must be narrowed
to 30 feet maximum and the boulders within the right of way must be removed.
We suggest that this proposal is premature and will only make it more difficult to further subdivide
when city services are made available east of CH 40. At the time when full development is proposed
this access to CH 40 may be eliminated and all access will be to an internal street network.
