Northern Auto Services is requesting a Conditional Use Permit to allow the sale of
automobiles.

Overview
The applicant currendy operates an oil change and lube business on this property. The
property is zoned C3 (Highway Commercial) and is 1 acre in size. Adjacent land uses include
Kentucky Fried Chicken, a small commercial strip center and an office building. The
property is a comer lot with frontage on Dodge Avenue and 5th Street. The applicant is
proposing to install 7 concrete pads in the grass area at the northeast corner of 5th Street and
Dodge Avenue. These pads will be used to display vehicles that the applicant will have for
sale. The oil change and lube business will continue to operate from this site.
Analysis
Auto sales require a conditional use permit. The limited number of cars proposed to be for
sale (7) should not have a significant impact on the area. The cars will be driven on to the
pads from the interior of the property. A new curb cut will be installed along the existing
driveway off of 5th Street. There will be no direct access to the pads from a public street. The
applicant is proposing a 10 foot setback between the pads and the property line. A 10 foot
setback is what is required for any parking area. No additional lighting is shown on the site
plan. No new signage is proposed. No modifications to the existing driveways and parking
areas, other than the new curb cut, are proposed. The proposed 7 pads should not have a
significant impact on the drainage on the site; stormwater will continue to drain as it
currendy does.
The applicant will be changing the current landscaping on the site. The landscape plan
includes landscape beds in front of the pads. Landscaping in those beds include several
species of bushes, daylilies and arborvitae. There are two existing landscape beds that will be
removed. The landscaping includes a birch tree, 4 flowering crab trees and several bushes.
There a~e also four evergreen trees that the applicant plans on keeping. Since the birch and
flowering crab trees were included on the approved landscape plan that was part of the
original conditional use permit approved in 1993, they will have to be replaced. The area that
will be used to access the display pads will be surfaced with a honeycombed material that
provides a stable driving surface while allowing grass to grow through.
Plannina Commission Meetina
At the Planning Commission meeting held on April 27t\ two people spoke at the public
hearing. Their comments included the following:
. Are the pads setback far enough from future improvements to Dodge Avenue?
. Installing some type of surface in the area behind the pads so that it does not turn to
mud when it is wet
. Replacing and/ or replanting landscaping that will be removed
. Traffic impacts on the intersection of Dodge and 5th Street
. A means to prevent people from driving vehicles off the front of the pads and onto
the street.

The Commission also discussed the need to keep people from driving off the front of the
pads and the need for a deeper setback. One commissioner felt that the proposal was too
intense for the area.
The City Engineer has recommended that the pads be setback 15 feet from the property line
instead of the proposed 10 feet. This should allow sufficient space between the pads and the
sidewalk the will be installed along Dodge Avenue. The applicant is proposing to provide a
solid driving surface behind the pads. The landscape plan shows replacement and relocated
landscaping. Bumpers will be placed at the front of the pads and the front of the pads will be
landscaped.
Recommendation
The Planning Commission and staff recommend that the City Council approve this request
with the following conditions:
1. The number of cars for sale on this site shall be limited to 7 . Vehicles shall be street
operable and in aesthetically pleasing condition.
2. No direct access from the pad to a public street is allowed.
3. Comply with State of Minnesota licensing requirements.
4. The pads shall be setback 15 feet from the property lines.
5. Bumpers shall be installed at the front of the pads.
6. The front of the pads shall be landscaped.
7. The area behind the pads that will be used for access shall be surfaced with a material
that provides a stable driving surface and allows grass to grow.
8. The birch tree and four flowering crabs trees that will be removed shall be replaced
somewhere on site. Should any of the evergreen trees south of the building be
removed, they shall also be replaced.
