EXTRACT OF MINUTES OF MEETING OF THE COUNCIL OF
THE CITY OF ELK RIVER, SHERBURNE COUNTY, MINNESOTA
RESOLUTION ACCEPTING BID
Pursuant to due call and notice thereof, a meeting of the Council of
the City of Elk River was duly held at City Council Chambers on the 4th day
of September, 1979 at 7:30 o'clock P.M.
The following members were present:
Mayor.Madsen, Councilmembers Duitsman, Engstrom, Otto and Toth.
The following members were absent: None

• Councilman Otto introduced the following resolution
and moved its adoption:
RESOLUTION ACCEPTING BID
WHEREAS, pursuant to an advertisement for bids for the following improve-
ments, to-wit:
Street Improvements, Xenia Avenue and 6th Lane.
bids were received, opened and tabulated according to law and the following
bids were received complying with the advertisement.
Bidder Amount of Bid
N.D.H. , Inc. , Anoka $10,060
and
WHEREAS, it appears that N.D.H. , Inc. of Anoka, Minnesota is the lowest
responsible bidder.
• RIVER:NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ELK
"1 . The mayor and manager are hereby authorized and directed
to enter into the attached contract with N.D.H. , Inc. of Anoka,
Minnesota in the name of the City of Elk River for the improve-
ments aforesaid according to the plans and specifications therefor
approved by the Council and on file in the office of the Clerk".
"2. The City Clerk is hereby authorized and directed to return
forthwith to all bidders the deposits made with their bids, except
that the deposits of the successful bidder and the next lowest
bidder shall be retained until a contract has been signed". -
The motion for the adoption of the foregoing resolution was duly
seconded by Councilman Duitsman and upon vote being taken
thereon, the following voted in favor thereof:
Councilmembers Duitsman, Engstrom, Otto and Toth.

I , the undersigned, being the duly qualified and acting Clerk of the
City of Elk River, Minnesota, hereby certify that I have carefully compared
the attached and foregoing extract of minutes of a regular
meeting of the City Council of said city held September 4 , 19 79 ,
with the original thereof on file in my office and the same is a full , true
and complete transcript therefrom insofar as the same relates to the issuance
and sale of bonds for
