RESOLUTION NO. 79-35
RESOLUTION ORDERING THE CONSTRUCTION OF
A RAIL CROSSING IMPROVEMENT TO SERVE THAT AREA
KNOWN AS THE PETERSON ADDITION AND AUTHORIZING
THE MAYOR AND CITY ADMINISTRATOR TO ENTER INTO
A CONTRACTUAL AGREEMENT WITH THE BURLINGTON NORTHERN
RAILROAD TO ACCOMPLISH SAID CONSTRUCTION
WHEREAS, a public hearing was conducted on August 20, 1979 at the Elk
River City Council meeting; and,
WHEREAS, a legal notice of the public hearing was published in the offi-
cial City newspaper and affected property owners were given ten
days mailed notice; and,
WHEREAS, the Burlington Northern Railroad is the only agency which con-
structs public rail crossings; and,
WHEREAS, the City of Elk River has received and reviewed a contractual
agreement between the Burlington Northern Railroad and the City
of Elk River for the installation of a railroad crossing to ser-
vice the Peterson Addition.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River
• that construction of a public rail crossing to service the Peterson
Addition is hereby ordered and approved and that the Mayor and City
Administrator are hereby authorized to enter into a contractual
agreement with the Burlington Northern Railroad for the construction
of the public rail crossing to service the Peterson Addition.
Adopted this 20th day of August, 1979, by the City Council of the City of
Elk River.
