AUTHORIZING THE WITHDRAWAL OF THE ELK RIVER
MUNICIPAL UTILITIES COMMISSION FROM THE
UNITED MINNESOTA MUNICIPAL POWER
AGENCY
WHEREAS, the Elk River Municipal Utilities Commission is currently a member of
the United Minnesota Municapal Power Agency; and,
WHEREAS, the City Council of the City of Elk River and the Elk River Municipal
Utilities Commission have determined that continued membership in the
United Minnesota Municipal Power Agency is no longer in the best
interests of the City of Elk River and the Elk River Municipal Utilities
Commission; and,
WHEREAS, Section 9. Sub. a. Sub. 4. of the Agency agreement states that members
may withdraw from the Agency upon filing a certified copy of a resolu-
tion, expressing the desire to withdraw from the Agency with the Secre-
tary of State of Minnesota and the Board of Directors of the Agency
and upon fulfilling all financial obligations incurred on behalf of the
membership by the Agency Board.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River that
. the City of Elk River withdraw from the United Minnesota Municipal Power Agency,
and that the Clerk/Administrator of the City be directed to file a certified copy
of this resolution with the Board of Directors of the United Minnesota Municipal
Power Agency and the Secretary of State of Minnesota; and,
BE IT FURTHER RESOLVED that in accordance with Section 9. Sub. a. Sub. 4. and
Section 9. Sub. I. of the Agency's agreement, the City hereby agrees to fulfill all
financial obligations associated with its membership up to this point in time.
